I would suspect that this is not quite related to a expired passport ... but I may be wrong. I would need to read the Bill behind the act. I would suspect this is more about illegal immigrant that has crossed the border without the correct papers.

As far as I recall, a passport expiring is not the same as expiry of a residence permit. What caused the car to skid out of control? What were the road conditions like? If you can prove the weather conditions were bad (took pictures, video etc), and you can prove (how? camera) that you were driving at the speed limit, AFAIK, you could request a correction.
