Finnish interpol refused to cover extradition cost

Dear All,
I am with Japanese citizenship, I had a court case against me (for stealing 20000 cash in a shop,which I did not) in Finland a few years ago, now I have been caught in South Africa travelling here. now I have been detained here for four months now, even went to detaintion room for 8 days. I have suffered mentally and phsically. South Africa contacted Finnish police, and Finnish embassy, they give no responce. There is no extradition agreement between South Africa and Finland. I am Japanese citizen.
Now south african interpol said until the extradition agreement is made between South Africa and Finland( which may never happen), I will be detained here. I wonder if I can sue the Finnish interpol? or Report this to interpol headquarters in Lyon, France? Finland gives no respond to this issues, so South Africa is going to detain me forever????

My questions are :
1. How long can South Africa detain me here?
2. Finland does want to cover the extradition cost, if I report to interpol headquarters, Finnish interpol does not follow the rules(requesting country pays the flight,food,accomondation cost for suspect), will the red notice be cancelled?
3. Finland wants me to face the trial and pay all by myself, it that legal to ask me to pay all the cost when I am a suspect????????????
4. What happens if red notice requesting country refused to pay the extradition cost? Is this considered as invading my human rights? Because I travel to some country, I suffer from be in jail for a few month because of Finnish red notice, but Finland refused to extradite me.... Can I sue Finnish police to cancel the red notice if they do not extradise me from Africa?
5. If there is no extradition agreement, can they transfter a suspect through interpol system and privately buy me a flight ticket and send me on the airplane without notifying the Japanese embassy? If they can, there are 192 interpol member countries, they can transfter suspects freely?

Have you tried contacting the Finnish Embassy there yourself?

The Japanese embassy should be able to give you all necessary information and establish legal consultation for you, are you in contact with them?

Sometimes problems will catch up with you.
Your situation in short is that you have to pay everything yourself. Contact the Japanese embassy for help. (in an other topic you wrote you were Chinese. What is the truth?)
I read your older topics and you seem to make a mesh of your life. So your present situation is no surprise for me.

Finland has no extradition treaty with South Africa, that is what I was told from Finnish embassy. But South Africa foreign affairs saying South Africa is memeber of interpol country, so I will be transfered to Finland, however Finland does not want to cover the cost. Also South Africa wants to use me to exchange political prisoners who scaped away fro S.A. to Finland. In this way, they do not need extradition treaty

My own embassy has no information regarding my case, they never met this kind of case before. Asian guy in Africa with red notice , planning to transfered to Europe without extradition treaty... I am surprised...

I am not willing to give real ID information over the internet, i am asking for help by telling the story, it do not matter which nationality I have, but i am Asian. So i wonder how the extradition works if two countries do not have extradition treaty and Finland does not want to cover the cost? South Africa has to pay for me ?Because South Africa is a member of interpol. But my embassy said, without extradition teaty, i will not be transfered. However I was kept here for 4 months now... Can I sue Finnish interpol to interpol headquater? If you publish a red notice, someone helped you to catch the guy, but you do not pay for the transfer, it breaks the international extradition law?South Africa refused to release me but also refused to pay for my transfer, this invaded my human rights. So who will pay for the transfer? I also refused to pay for Finnish police flight ticket coming here to get me back to Finland and cover my own hotel cost until the case is solved..

The thing is, nobody here will be able to really help you. You need a good and highly specialised lawyer. Your embassy might not have all the information you need, but they should be able to organise proper legal representation. As people said, you ignored the advice given, and now you are in the worst possible situation.

Repeating your story here over and over will not change your situation.
The officials have said; "We will not pay" and "We cannot help" then you're on your own.
You just have to pay yourself or wait in prison till S-Africa is tired of feeding you.
If you're not a native black S-African you cannot expect much help from the local authorities.

n.b. Having access to internet is not something I would expect in a S-African prison. :twisted:

My salary was 2600e, after tax I got 1900e. But my sales commission is not my salary, it was reward for my effort to bring business to my ex-employer.

Good to know. I will ask first thing in the morning our payroll to stop paying my salary and to grant me reward equal to my gross salary instead. No taxes anymore! Thank you for the hint! Am I correct when assuming your employer was not a Finn?

I also refused to pay for Finnish police flight ticket coming here to get me back to Finland and cover my own hotel cost until the case is solved.

Wow. This is so easy. You don't pay for travel costs of the Finnish police = you save money = you won't end up in Finland for trial = perfect! Seriously, poor Finnish police would come and get you if you agreed to pay their tickets. Would they take the opportunity to bring their families too so they could have a nice vacation at the same time? On the serious note, should it happen Finnish police escorts you to Finland I would not be too worried about hotel costs. I strongly believe you would lodge behind bars.

I am on probation, I paid 2000 Euros for that in South Africa. They took away my passport and refused to let me leave, but Finland does not want me to transfer back to Finland because South Africa would not pay for my transfer. Does Finnish interpol invaded my human rights? I am suffering here and Japanese embassy talked to the interpol but no one would like to cover the transfer. So I will wait two more weeks then sue the Finnish interpol to international court. Red notice issuing country has to cover the transfer cost!..

I am not listed in this website... But the point is how it can happen if Finland has not signed extradition treaty with South Africa? Without extradition treaty, you can transfer suspect from anywhere to anywhere because both countries are members of Interpol? There are 192 interpol memeber countries in the world, so suspect can transfered freely between Asian, America, Africa with Finland????????

Great info, thanks!!!!! I have written an email with signature to fairtrials. The problem is, there is no Good South African lawyers, and they charge me 5000 US Dollars. 3000 Dollars first, when the case finishes, pay another 2000 Dollars. The court said i have no case in South Africa. I just have to wait... But I do not know how long I should wait as maximum. Finnish lawyers refused my case because I am in African instead of Finland...

No, it is not human right to have your extradition paid by someone. Specially as you claim S.Africa and Finland not having treaty.
If S.Africa is actually trying to have some kind of trade deal to have people extradited from Finland in exchange or extraditing you then there is no extradition. South Africa can keep you detained as long as their laws permit if they hope to use you as bargaining chip.

Finland is not responsible for actions or lack of them of S.Africa.
And trying to sue Finland is pointless waste of time and effort of everyone.
