holiday sick leave

Post by coma » Sun May 11, 2014 10:24 am

Hello,

Can you please help with this.
I was on my summer holidays then I got sick during and after my holiday ended. I sent a sick leave certificate to cover a 3 weeks period that follow my offcifial holiday period BUT WAS REJECTED BY MY EMPLOYER. The reason was that the certificate comes from abroad but not Finland.

I complained then he promised to pay 3 days only!!

Is this legal? Am I not entitiled to get paid sick leave? Can I recover also the days I was sick during my official holidays?

Thanks a lot.

There is no absolute right to refuse a foreign certificate. The link says the employer needs to be able to reliable see from the certificate that you were unable to work. I would just book a time to your employee health care here in Finland and see if they will issue you a Finnish one based on the foreign one.

What do you mean with this? You always get paid for your holidays. If you are sick during holidays you can move the days to another time.

Everyone is entitled to get paid sick leave. You should check your collective bargaining agreement (työehtosopimus) for specifics. See my previous link. If you let the employer know without undue delay, then you should be entitled to keep the holidays at a later point in time.

hello again,

Thanks for your reply.
Out of the 3 weeks sick leave that happened after my official holiday ended, my employer paid 3 days only and this why it felt so fishy! The other days were counted as unpaid holiday. The sick leave certificate I sent from abroad covers 3 weeks.

If there is any good reason to refuse a foreign certificate, why did they pay 3 days?!
Anyone who has experienced similar situation, please share;)

Cheers.

Some workplaces allow an employee to be off sick for 3 days before requiring a doctor's certificate. Without the note, they aren't required to pay sicktime.
And some might accept any doctor, but they don't have to.
