Hi,

According to standard Finnish law, do I get severance if I get fired on toistaiseksi sopimus (permament contract) - being employed for 1 year 4 months ?

At least according to this definition, severance is always a private contract matter: "The receipt of a severance package is contingent upon signing a severance agreement."

Finnish employment law does not provide any extra money at the end of employment if the firing was legal.

Thanks for the info. What do you mean legal ? When is it not legal ? Can it ever be not legal ?

There has to be legal grounds for it. Far most common one is the "Tuotannolliset ja taloudelliset syyt" (= the business for the company is bad). That particular reason requires first the YT-neuvottelu (negotiation) in companies that have at least 20 employees.

Did your company have YT (and does it have at least 20 employees)?

Nordea did YT a couple years ago just to prepare for the future and be more profitable. There was some backlash for it but I don't remember to being classified as illegal. It's more common of course for business to be bad but it does not seem to be a requirement.

It's not legal if there is no particular reason for it, ie you can't be fired out of the blue. This is why economical reasons also mean that the same employer has to hire you back if they hire after firing. It is known that some sites like Uudetkasinot.com do respect this way of action though outside jurisdiction :thumbsup:

You definately get your holiday compensation which is earned holidays in a period of time , by which you cant take your holidays because you no longer work there.They have to pay this immediately if you ask for it, by that i mean they cant wait until normal pay cycle.
