TES is a general agreement regarding working hours, pay, vacations days etc.. Whatever else you do on your own time otherwise has nothing to do with TES. So the answer in general is yes, it's completely legal to have a business while working for someone else.
There may be an issue if the startup works in the same or similar field as your current employer. If not, no problem, just go ahead and do it. If unsure, check with your current employer and ask for a written statement from them, giving their agreement for your work with the startup.
