In the 2023 thread I have shared with you that I have sent a complaint to the Oikeuskansleri about the processing times (back then I was 15 months waiting). So today I have got the decision from them that says that Migri has assigned my application to the “demanding” queue based on the fact that my trips abroad and their impact on the time lived should be considered better. However, Oikeuskansleri has decided, that
“In the context of legal supervision practices, it is generally considered that an authority cannot validly invoke a congested work situation or insufficient resources as a reason for delays in handling matters. Instead, it must strive to ensure that it has the resources and effective work methods allocated for the proper management of tasks in any given situation. The authority should influence its own operations through efficient work management, organization of labor, development of operational methods, and other available means to improve workflow, so that the law can be followed and matters can be processed without undue delay.
The appropriateness of processing times is assessed on a case-by-case basis, depending on the nature of the matter and the individual circumstances associated with it. Attention is paid to factors such as the complexity, difficulty, and number of actions required for processing the matter, as well as whether there have been stages during which the matter has not progressed.
Based on the available information, the processing of the complainant’s citizenship application has been delayed. The delay is partly due to the procedure of the Immigration Service. The one-year processing time target set by the Immigration Service has been clearly exceeded in this case. Although the Citizenship Act does not define a maximum processing time for citizenship applications, it must be taken into account that citizenship has a significant legal impact on an individual. For example, many participation rights and certain other rights are directly linked to citizenship. When it is a matter of a legally very significant decision from the individual’s perspective, the authority must also pay special attention to the expeditious processing of the matter.”
And the actions are as follows:
“I draw the Immigration Service’s attention to the compliance with the provision concerning the expeditious processing of matters.
I request the Immigration Service to inform me with specific details by no later than September 20, 2024, on how the processing times for citizenship applications have developed in recent years, whether the processing times have been shortened by the actions mentioned by the Immigration Service, and what additional measures may have been planned to further reduce the processing times.”
