EU citizen with non-EU wife, working in Helsinki for less than 3 months

Post by omnigut » Mon Apr 08, 2019 3:21 pm

Hi all,
I've had trouble using the search function on this forum, and I'm not sure this specific question would have been answered.

My wife is Colombian. I am Irish. We just got to Finland. She would like to do some consulting work for start-up companies while we are here for two months. Does she need a residency card or work permit to work in Finland for less than 3 months?

The sites out there are non-conclusive:

Colombian Citizens Visiting Finland (Etias Europe)
"A valid passport is required to enter Finland." – So, she doesn't need an entrance visa.

Your Non-EU Spouse and Children (europa.eu)
"Your non-EU spouse...may stay with you in another EU country. If they stay for less than 3 months, all they need is a valid passport" – We are staying for less than three months.

"During their stay, your spouse...should be treated as nationals of the host country, notably regarding access to employment, pay, benefits facilitating access to work." – This specifically says she has the same rights as me. So, she doesn't need a work permit to work for less than three months.

Employment, Social Affairs & Inclusion – (Europa.eu)
"When an EU national is working abroad in another EU country, family members also have the right to reside and work in that country, regardless of their nationality...Family members do not need a work permit to work, even if they are non-EU nationals." – Again, my wife should have the right to work.

BUT, all the other sites I've been to say that a non-EU citizen who is married to an EU citizen can only work in that country if they have a residence permit:

"If you plan to work in Finland, you need a residence permit in Finland." – Migri.fi

And from that same page:

"The citizens of EU and EEA countries and their family members have the right to work in Finland without restrictions. However, they must register their right of residence or apply for a residence card for a family member."

So, I'm assuming my wife does not need a residence card or work permit to work in Finland, because we are only here for 2 months.

Is that right?

Unfortunately, this doesn't cover my question about a non-EU citizen married to an EU citizen living/working in Helsinki for less than three months :(
