Submitting documents after an application

Post by sijazme » Mon Jul 22, 2019 2:38 am

I am applying for a family based resident permit and our marriage certificate is due to be delivered next month, however, my migri interview is before that date. Can I upload the marriage certificate to migri after the interview and fingerprints?

Yes, you can. If they need to see the original they will ask but in general is not needed.

So it's okay to submit an incomplete application without a marriage certificate and then submit the certificate at a later date?

Didn't we go through this already? You are not applying for residence permit. https://migri.fi/en/residence-card-for-family-members

I am not applying for a resident permit?

Isn't a residence card that is issued for being a family member of an EU citizen also a resident permit?
Or are you implying that as a family member of an EU citizen, I have an automatic right of residence
in Finland and therefore no EXPLICIT permission is required and my family residence card is not an
actual PERMIT in that sense but a document confirming my right of residence in Europe?

Explain please.

I don't imply anything. I just look at boxes that Finnish immigration service provides and tick them according to the info you provided. If you are married to EU, Nordic, Swiss or Lichtenstein citizen, you won't tick the residence permit box. For that your spouse needs to be not from those countries mentioned and living here with residence permit. As your spouse is from Iceland, thus from Nordic country, you do tick the residence card box. Just like with cars, you can fill up with fuel, but it wont work if you did it with diesel when you should have gotten gas.

If you apply for residence permit, you'll get residence permit card: https://migri.fi/en/residence-permit-card
If you apply for Residence card in Finland for a family member of an EU citizen, you'll get residence card: https://migri.fi/en/residence-card-and-its-renewal

But hey, if you want to apply for residence permit and pay 420€ and get denied, go ahead. Residence card is 54€.

Kind of happy now that wife is Nordic, also I hear under EU law the family residence card is valid for 5 years.

It is five years under Finnish law: https://www.finlex.fi/fi/laki/ajantasa/ ... ki#L10P154

Bonus tidbit: you would be applying for the residence permit, if your wife was Finn. Thus spouses of EU/nordic/etc. are in better position when moving to Finland than spouses of native Finns.

Do you have to fullfil this requirements too?
Persons living continuously in a marriage-like relationship in the same household, regardless of their sex, are comparable to cohabiting partners if
they have lived in the same household for at least two years; or
they have a child in their joint custody; or
they can be considered to be cohabiting partners for another weighty reason.
