Appeal Process - Adminstrative court sends case back to Migri

Hello guys,

As my subject,I received a negative decision from Migri last year in November for my first time student residence permit.I appealed the case through a lawyer and two weeks ago,the court sent the case back to immigration for reassessment. So my question is - Is it now obvious that Migri will give a positive decision?

It's also important to note that- The adminstrative court said that their decision can not be appealed.Anyone with experience on this,please advice.

So my question is - Is it now obvious that Migri will give a positive decision?
No. The administrative court thinks Migri made a mistake with the procedure or overlooked some information or didn't motivate their decision. So it is possible their decision was wrong. If it was obvious the decision was wrong, the court would have given you your RP.
The adminstrative court said that their decision can not be appealed.
Since the procedure is now going back one step in the ladder, appealing one step higher doesn't make sense. The supreme court would wait till migri made a new decision that you could appeal. Then the administrative court could make a final decision that would be open for appeal.

Sorry - I dont get this explanation. The adminstrative courts response to Migri in its return for reprocessing (I belive it was referring to Migri) that it - Migri,cant appel the decision.In my understanding. And the supreme court only gets involved when the Administrative court decision is appealed,which in this case it's not possible.

The case was rather straight forward if you asked me because Migri didn't understand certain documents and after clarification of course through a Lawyer, Migri was asked to recess.The stage we are in now - So then,where in this case does the supreme court issue that you have raised come in?

@Rinso,if am to ask you,If whatever the issue was when he or she got the negative decision was clarified and amended as stated,and the appellant got a positive decision from the adminstrative court,can Migri still give a negative decision?

Yes, for example, if you have been convicted of crimes in the meanwhile.

Yes, for example, if you have been convicted of crimes in the meanwhile.
Let me ride on @mitchie question.No,I have not been convcted of any crime in the recent past...well,never.It was my first time Residence permit as am not in Finland yet.So then,what could be the odds?

The odds depend on the original reason for rejection and how that was misunderstood or is addressed with new information/proper interpretation. If the reason for rejection is cleared up and there are no other reasons, then chances are very good.

Thanks,am actually not in Finland at the moment. It was my first time Residence permit.When we sent in our appeal and explanation in details - As tho to a 2year old,the documents that Migri didnt understand,hence the rejection or negative decision,they responded after 4months in the affirmative that the documents are now clear,and not suspicious anymore,they will however let the court decide on the way forward.5months later,the court gave a positive decision requesting Migri to reassess the application and give a new decision.

That's why am curious to know wether Migri can again give a negative decision,based on anyones anyone's experience.

In theory Migri can again give a negative decision.
In practice it is likely that you will get a positive decision from Migri.

what is considered an offence for migration purposes? where is the threshold for this? speeding fines or more serious things like assault.
The bar is "a danger to public order or security". The threshold is individual as courts have to take into account things like the interests of children who would stay in the country.

This is a straight forward case, I don't know why all the big grammar and drama. Migri gives you a negative decision and you appeal to administrative court , when they give a positive decision over your case and send back to migri for reassurancement, there is 99% chance migri will agree with administrative courts decision. For migri to go against administrative courts decisions is not usual, this depends mostly if you have committed a crime with this period of time, but if not, be prepared for your resident card arrival. (SPEAKING FROM EXPERIENCE) Good luck!

Yes I did get a positive decision and a permit was granted in tjat regard.
