PLEASE I NEED AN ANSWER

Post by Kledis » Sat Nov 23, 2019 7:50 pm

I KNOW THAT ON FIRST SIGHT IT IS A LOT TO READ BUT PLEASE PROVIDE ME WITH SOME ANSWER BECAUSE I HAVE BEEN GOING THROUGH A LOT

I started the academic year 2018-2019 and was able to finish it but through a lot of sacrifices because of the problems that I had with the residence permit.
I made a electronic residence permit application for studies in the Embassy of Finland in the beginning of August and came back to my country. The university was going to start at the end of August so I was obliged to go in Finland and wait for the decision while I was studying.I went to Finland because my counry has free visas for the period of 3 months. And I thought since 1 months was done waiting I will have 3 more months to stay in Finland and hopefully I was going to take a decision during this period of time.Because Migri said that an electronic residence permit application won't take more than 2 months for a decision.
As I was studying the decision was not coming from the Embassy of Finland and my 3 months free visa was expiring so I had 2 options.
One was to come back in my country a wait for the decision but doing that I could not follow my studies and the second option was to cancel the application that I did in the Finnish Embassy in Greece and do a new one in Finland so at least I could stay legally in Finland to wait for the decision eventhough it might took more than the expected time.Meaning that I do not break any rule of Schengen Area.
I made the second application for the residence permit and this time I choose to do an paper residence permit application which would take around 4 months to have a decision. When I did the second application I also required the cancellation of the first one that I did in the Embassy of Finland in Greece.

The second application was done also with my request to cancel the first one.So now I could stay legally in Finland without breaking any rules of Schengen Area. While I was waiting for the second application that was done in Finland Migri requested me additional information about the source of funds.Since in the first application my fund was supported by my parents I have said that my parents were the one who supported me.During the time I came in Finland I had to use that money for my living costs. And when the time came to do the second application I did not have 6720 Euro in my bank account but less because I was living in Finland. To complete the amount of 6720 Euro before sending my application paper my uncle gave the missing amount of money and I completed again 6720 Euro. But since my uncle gave me that money I said that he sponsored me.
Time passed, like 4 months and I was in the end of the first academic year and finally I got a negative decison for the second application and also after 8 months the first application was cancelled.
The main reason for a negative decision was that on the first application I said that my parents sponsored me and in the second application I said that my uncle sponsored me.There were also other dumb reasons for the negative decision which were mentioned in decision.
I deciced to appeal the case. But first of all I had 30 days to leave Finland voluntarily and I did leave because the court did not aprove that I could stay.I think that they did this to me because of all the non senses that the senior adviser who made the decision said.
But during this time I was providing my lawyer with the documents that he was asking me to send to the court and we got rid of all the non senses that the senior adviser had said in the decision and we left only with the source of funds (only because on my first said that my parents sponsored me and that on the second application I said that my uncle sponsored me).
Despite all this thing I was able to finish my first academic year with a total of 90 Credits because I was a really good student.90 credits only in one year but still did not manage to get the residence permit.

CONCLUSION
I have registered for the academic year 2019-2020 absent because I thought that waiting the court decision is the right thing to do but as I am seeing it probably also this decision is going to be negative so I am thinking of doing a new application in the beginning of Aprill 2020 and for that I would like to make some questions.

-Is it okay that my mom takes a loan for my living costs in Finland ? Meaning that she will take 6720 Euro and all that money is going to be transferred to my back account and that she is going to do statement where she says that this money is in total free use of my son.And that of course I can use that money for my living costs in Finland.Because I am really worried that Migri again will try to connect this application that I will do with the case that is being proceded in the court.

You are making it so complicated. Application, retraction, appeal, new application, retraction, new application and all the time changing your financial situation ....... No wonder Migri thinks there is something smelly.
Make a solid plan with your lawyer and stick to it.

Your first application already made residence legal so there was no need to cancel the application for that purpose.

You should have stated both in the second application.

Residence continues to be legal while a court processes an appeal.

Minimum you should make a document that the money to you is a gift or if it's a loan then the payments need to start after the residence period validity.

You have a lawyer so why not use their advice instead of random people on the internet?
