Aliens Act, permit extension processing time 4 months limit?

Post by ilmainen_siideri » Fri May 20, 2016 5:08 pm

Hey!

On Migri's website (http://www.migri.fi/services/processing ... work_61172) it says "According to the Aliens Act, the maximum processing time for residence permits for work is 4 months". My questions are:

1) Does this apply to permit extensions as well or to first permits only?

2) If it applies to extensions too, then how could this viewtopic.php?f=2&t=92374 be possible? The guy is waiting for 10 months already. He called the Espoo police: "Espoo immigration unit said to me 2 months ago that we have only two or sometime 3 people which are working on RP applications so just wait".

3) Where in the Aliens Act does it say "4 months at most"? I could find anything about employment-based permit processing time here http://www.finlex.fi/en/laki/kaannokset ... 040301.pdf

I have applied for an extension (Espoo police station) 3 months ago, still waiting. My old permit expired a month ago, and I can't go for family and business trips now :(

Because the law doesn't come with any direct consequences to any official when the deadline is not met. They should budget enough resources to meet the timeline but as we can see...

In Section 82. The translation hasn't caught up to the amendment that introduced the time limit.

Thank you very much, betelgeuse, this makes everything very clear. And kind of sad... you basically can't rely on this paragraph of the law at all.

I've heard many times that Helsniki's police station are the slowest in this regard, and Espoo is faster, but I know people who got their permits in similar to mine situations in Helsinki in 2 months, and now I read that Espoo could be 5 times slower. Oh well.. should've applied for the extension the day I landed, I guess :)

I recommend that if your case takes over 4 months that you file a complaint to the parliamentary ombudsman. It's only requires filling a short online form so even if not much comes out if, it's worth the trouble.

Thank you, betelgeuse, you are, once again, extremely helpful. I'll quote your message in that other thread for mshouban to see (the guy who is waiting for 10 months).
