but some have their head screwed on and if they smell a big fight coming - they turn down the business!! (I know)
It depends how they contracted the claim. They could have taken over the claim (for a fraction of the value) and got stuck with the risk.
Giving up the claim would mean their loss. This seems to be a big enough claim to do some fighting for.

If the 'odor' of the stink is strong enough, they will back off - because whatever the claim contract is they will be forced to pay the lawyer bills - and, as is the case, they don't even get all their legal and court costs if they WIN!

It's possible - and even probable - they have their own lawyer in their employ - but it can be very possible there will be more lucrative cases.

Would the home insurance (basic one) cover it?

(before moving out and giving keys away)
