Applying for Wife's first residence permit

Hi I want to apply for my wife's first residence permit.
But the problem is that the marriage certificate I have is not legalized from India ( My home country )

Is there any chance I can still apply and hope for getting her application through and have residence permit for her.

I am having my own SSN and residence permit here in finland.

Any suggestions and hope will be highly appreciated.

I haven't got it legalized because I was nit sure that I will be staying long in Finland. but now due to project requirement my stay has got extended and I need to apply for my wife's residence permit. she is presently on tourist Visa .

Immigration department (of finland) has nothing to do with your marriage so what i see is you are trying a fraud.

Suspicion of a fake marriage is one of the main reasons for a rejection of a RP (based on family ties).
I bet not showing a legal marriage certificate is almost an automatic rejection.
Get the thing legalized before you even apply.

You have not said where it has been legalized. How did your wife get her tourist visa? Was it issued by a Finnish embassy? If so, did they issue with the knowledge that she was your wife? Pls. provide more info. if you want to have suggestions as to how you should proceed.

From Finnish tax point of view it would be waste of government resources to start clarifying if a not properly legalized foreign document is genuine or not. So, with no particular ill feeling toward you, I hope they won't even try and simply reject application not fulfilling the rather simple formal requirements. Get it done properly.

Another issue then is that your wife should have really applied while being abroad. Failing not to do so is not a reason for categoric rejection, but it does not help.

Well she got her tourist Visa based on our legal marriage certificate issues by the embassy of finland in India. But as I said earlier that my previous requirement of stay was not long hence we didn't go for legalizing it in our home country. But now as the need for stay has got extended the need for applying for her RP has come up. I can still get the marriage certificate legalized from our home country. In fact I have started the process but it will take at least 2 months time. But if don't apply for her RP now before 29th july then she has to leave the country , which I don't want.

Is it possible that I apply now , and after 2 months when it gets completely legalized from our home country I go and resubmit the legalized certificate.
I have heard that if they need more clarification/ document then they ask the applicant to submit them at a later date. Is it true, if yes then how much time will I get to submit the legalized marriage certificate in this case .

Any suggestions.........

It creates confusion. And confusion easily leads to delays or even rejection.

I don't understand how come simple Apostille from public notary + the time to send to document to India and back by DHL or similar service should take 2 months?

Legalization has two steps :
1) Stamping by state home department - Takes about 1.5 months in case of my home state as every damn thing is handled manually and the system is very lousy.
2) Stamping by ministry of external affairs of india - takes 2 days

and then the transit time. Thats why I was referring two months in total approximately.

After quick Google search: So seems to be the case. I thought the Apostille certification is supposed to be rather quick and easy, but not so in India....

They even have individual page on the Migri page about the necessity to have marriage of similar certificates legalized: http://www.migri.fi/netcomm/content.asp ... anguage=EN

She can of course take the papers to the local police station and see what they say, but she is really supposed to apply via the Finnish embassy in India anyway. I would not be hopeful.

why not ask the Indian embassy in Finland if they can be of any help concerning apostile and secondly, why not personally confirm from the police station of ur city.

Because police don't issue the first RP for non EU nationals who aren't married to Finn residing in Finland.

"The first fixed-term residence permit is granted by the Finnish Immigration Service, and subsequently a new fixed-term residence permit (extended permit) can be issued by the police. However, the first fixed term residence permit for a family member of a Finnish citizen resident in Finland or a family member's unmarried child is also issued by the police."
