Court give negative RP decision, what to do next?
Re: Court give negative RP decision, what to do next?
The supreme administrative court looks at the process of your first application and appeal, they don't look at new circumstances.
A rejection will be enforced whether or not you have a new job.
You can apply again from your home country.
Please try to understand; when the supreme administrative court says no you will have to leave.

Re: Court give negative RP decision, what to do next?
How if I make the appeal and apply for a new RP at the same time? The appeal can take several months before the Supreme court gives desicion and I may get the new RP before that. Is that possibble?rinso wrote:The supreme administrative court looks at the process of your first application and appeal, they don't look at new circumstances.

They won't process your application if there is an appeal running.

Hmm, this is not true. My friend whose RP has been denied by the police and while waiting for the court decision he applied a new RP based on a new ground and he got it.rinso wrote:They won't process your application if there is an appeal running.

If you know it all, why do you ask?
Re: Court give negative RP decision, what to do next?
@rinso: I don't know it all as you said. What I only know is two cases with my friends: one got the RP by making a new application while his appeal is pending, another got RP by following the police advice (applying a new one) after the Supreme court gave negative decision. I'm just trying to convince myself that my case can work somehow but I'm totally confused because the cases with my friend prove that things we have been discussing so far here can either work or not work in reality. They can work for some people but there is no guarantee that it will work for me. That's why I am asking you guys in a hope that your experience will shed some light on how I should do next.rinso wrote:If you know it all, why do you ask?

Look , the company you worked for in reality should be fined a penalty, therefore you need to understand that at some point you are partially suspect to the mis-management.reindeer wrote:@rinso: I don't know it all as you said. I had a really good spread out of various (aliens act quotes) , but im working all the time now and plus you can find those quotes and paste them for the other members.
Theoretically , unless you get work with a decent law abiding company that has a history, they may reject your new application(because your suspect).
I also checked the aliens act for any written words pertaining to "having a pending court appeal and legally being able to submit a new Res-permit.
there is no statement that says you cannot apply for anything while having a pending court-case.
But there is a written law in the aliens act that states that you can be expelled from the country even though your case is at administrative appeal court.
You just need to apply for the new res-permit, they will accept your application and money i am sure.
