Residence permit question (family ties)

Post by TwoThree » Wed May 22, 2013 2:57 pm

Hello.

A little back-story for my question: I am a non-EU citizen married to a Finnish one. I have applied about two months ago for a residence permit on the basis of family ties at the Finnish embassy in my home country and am waiting for it to be processed (I don't expect to hear from them anytime soon, obviously.) I'm cautiously optimistic about my chances, since my husband and I have been together for almost five years and have visited each other several times prior to our marriage. I provided what I believe is sufficient proof of relationship and had an interview at the embassy (on the same day I applied) which seems to have gone well. But if my application gets rejected I'm sure we'll figure something else out.

So let's say I get my RP in a few months (the average processing time seems to be four months, but I know it can be much longer); I asked my husband to call the immigration office and inquire about how long it is possible for me to wait before I can move to Finland. They told him I have to be there for at least half of the validity period of the permit, which I assume is six months.

What I'd like to know is, what if I move to Finland more than six months after getting the permit? The truth is, there are lots of things (both personal and professional) to sort out here before I can be with my husband so nothing is set in stone. One might ask why I applied so soon if I wasn't sure I would be able to move there as soon as possible. That's a valid question, but the answer is too complicated. So what is the risk here? Will my permit get cancelled after six months? Will I have trouble with renewing it after a year?

I imagine this isn't a common question around here, so I didn't really run a topic search. If it's been discussed before then I'd be grateful for links.

Thanks in advance for the help.

It would have been better if you had asked it from the immigration service. I doubt they cancel the permit (though I don't think I can see that as certainty. While I see no part of law indicating that as grounds for canceling the permit, small risk might be that it would be considered analogous to moving out of Finland) More likely is problems at renewal time. If your case looks otherwise strong maybe they issue new permit for one year only, instead of the standard four years.

Yeah, ultimately I think we will have to check with MIGRI. Just figured I'd ask here first, in case there's anyone with first-hand knowledge.

I didn't know the second permit would be for four years. I thought it would be another one-year permit. If that's the worst it can get, I can live with it :) But yeah, I better ask them. Thanks!
