How do I get my boyfriend from the USA to finland?

Post by Tampere <3 » Sun Aug 16, 2015 9:45 pm

Hello,
I really hope you can help me with this.
My boyfriend and I have met here in finland a few years ago. We were just friend back then but never lost contact.
Now things changed and we would like to live together.
I am not finnish myself and I don't have the finnish or shared citizenship yet. But I have an unlimited work contract and live over 8 years here already. :)
Marriage is not a topic yet and shouldn't be a solution for this problem, since we wanna see first how things go and if he really wants to stay here with me.

He is from the USA and this way things are a bit more complicated. :!:
I am not good with paperwork, so I hope someone here can tell me what to look for.
3 month tourist visa is not what we are looking for, at least a year would be much more helpful to see how things go,
make his finnish better and maybe get him a job.

If there was a similar topic like this I am also thankful for links.
I didn't check them all.

Kiitos paljon!

To stay here he needs a reason. Reasons are basically: work, study, family. So he finds work that no one in EU is able/willing to do, starts to study or marries you.

Weeelll there kinda is. If she's willing to sponsor him while he learns the language or find an employer who will wait for him to get an RP that allows him to do work, then he can probably try to get on "other grounds"

This can be an intermediary RP while he gets a better one like study RP, marriage, or work. It doesn't give him the right to work, and I'm not sure if it gives him the right to claim benefits (at least I hope it doesn't).
Every case is unique. You can't measure the result of your application based on arbitrary anecdotes online.

Sorry, but unless he gets into university there, marrying him is going to be the only realistic solution to the problem.
How is this even a solution? OP is not EU, and not Finnish. He still has no ties to Finland if that is the case.
As far as I can see, the only solution is either a work permit or study permit. Else the OP is going to have the same problem as the last girl who was in here who got their permit repeatedly denied due to no ties to Finland and they had to move back to Germany where they had a permit to live, but still no citizenship at all. Different story completely if OP is EU or has Finnish Citizenship then her 'boyfriend' gets freedom of movement or family ties etc.

But from what the OP is asking they have 2 options and 2 options only if he wants to come to Finland. Work or studies. Enrolment for next year is coming up soon. If he doesn't go for studying then he's basically got 'buckleys' of getting work = OP isn't going to be getting what she wants, not remotely.

Since when? We've had plenty of people in here who've had their permits denied due to NO TIES TO FINLAND. Regardless of if they wish to live with their spouse. You should know, I've seen you reply to many of them.

OP still only has 2 options unless she wants to go to the US herself, and then the whole topic changes.

Since I don't know, since forever!

OP has a residency permit. She is here legally. She is able to import her spouse by law. There are hundreds of threads in these forums of people who've done so. You're blathering (I assume) about people trying to emigrate all by themselves not having ties to Finland. There are no such requirements for people coming to Finland to reside with a family member who is already in possession of a residence permit.
That's true, the only limitation is that the 'imported' person cannot apply for a better status than the 'importing' person. This implies that if the person living in Finland has a type B residence permit, the spouse won't get a type A permit based on being married to that person. I think that's hardly a problem in OP's case, except that requires them to get married.

The word "probably" is optimistic here, i think. But it is the only option if work, studies or marriage wont do.

I have a classmate at integration course whose husband is neither Fin nor Eu citizen who got a residence permit. As long as your husband/partner earns 1,700 per month (plus if you have kids, you need to earn more depending on how many kids), you may qualify for a permit. That and some other requirement you can find at migri website. Anyway bottomline is --it is possible.

They can pay and apply, but I doubt they'll get approved. That's seriously for cases where situations are so dang weird that they don't fit the mould... not, "I don't meet the requirements but I really, really wanna" ie this case. Hank has said as much many times. And it's a 99% probability that the work one is going to fail the "could not fill it from within the EU" test.
In 2014 the other category had 185 approved and 96 denied applications. Because it's "other" it's impossible to say how many of these are in the intent to marry category but based on the numbers I would say there's a fair chance to get a residence permit based on that.

OP already said
Marriage is not a topic yet and shouldn't be a solution for this problem, since we wanna see first how things go and if he really wants to stay here with me.
Besides we really do have hundreds of threads here of people being declined an RP for SPECIFICALLY NO TIES TO FINLAND. Regardless of being married to someone who has a valid RP to live here. That's a fact. Maybe OP can get married and get a 1 year permit or whatever then but that doesn't mean that the extensions are going to come easy and if someone in the police station wants to argue specifics they could still decline the application.

Thanks for all the answers I wasn't here since about a week because I was busy with running to all the official offices.

Now I am better educated about the matter and can tell you what's possible.

The best way for me would be still that he get's a job or finds a place to study.

The easiest way on the other hand is to get married(as most of you suggested already), that I learned for sure.
I am EU-citizen and have a job with unlimited work contract.
They told me in the police station that me being german and he being US-citizen(not sure if it's about german or EU) is a special constellation and the resident permit would be as well the work permit. Also it is easier since I have a regular income and an unlimited work contract.
But for the resident permit to go through we need to get married(since there is no workplace in sigh yet).
Which is the easiest way to work out, as long as I am employed.

The one lady on the phone said they don't check the income of the importing person if he/she is finnish citizen. But they do if he/she is EU-citizen.
She said that I need to earn at least 1700€ (not sure if gross or net) - 1000 for myself and 700 to support him.
The lady at the policestation said they won't check a number but I need to have a regular income and a unlimitied work contract.
Not sure which one is true, since I have to bring my last 6 payslips with me when we apply for the resident permit.
When he comes he also has money(savings) so he doesn't come to get support here.
He has a job in the USA and makes good money.
He just doesn't wanna live there anymore and of course wants to be with me.

I also learned that there are jobs that don't have to be offered to an finnish citizen or an EU-citizen first. Like country side or farm work as well as nurse work.
For example picking starwberries in summer. Sure this is limited but of course brings some money as well. He is willing to do everything and as soon as here is here I will check finnish courses with him and also hygine- and alcohol pass courses.

Next step is still looking for stupy places.
I am optimistic :)

Thanks for all your help :)

I think would be net, though by EU law they should not really give specific limits but consider all aspects of the case individually.

If he gets permit as a family member (spouse) he can work at any job he can find. If he tries to get permit based on employment, then there are limitations.
