Hi,
How do we know if we have joint-custody ?
In some legal articles, I read unmarried couples, even if living together do not have it.
“f the mother of the child is not married, she is the sole custodian. Also after the establishment of paternity, the mother will remain the sole custodian, unless the parents agree otherwise or a court order is issued in the matter.”
https://oikeus.fi/en/index/esitteet/kan ... uolto.html
Here is my situation.
I’m unmarried
Have a Finnish boyFriend
Have been living together for over 10 years
Our kid 2 years old.
He is the father.
She is Finnish since born here.
We did sign in the Neuvola the paternity recognition.
"issyden tunnustamista koskeva asiakirja" and the "Lapsen syntymää edeltävä yhteishuoltosopimus".
> in Finnish (I was told, they should have provided it in English since I can’t speak Finnish). Though they translated it.
Does it mean it gives joint-custody (the article above says no).
To summarize:
the relationship is almost over.
He’s been threading me that I cannot leave Finland without his consent since she’s born: even when I needed to to to rest to my family’s because I had no one to help me (him included).
For instance that was his threat for xmas holiday too.
I would like to know if what he says it’s true.
How does it work in practice?
Ex: if I decide to leave and take an apartment in Finland. Is it considered as a banding the family house, and so guilty as irresponsible parents or..
This is a very though situation for me. He’s been threading me for long now (he’s gonna have our baby, I’m not allowed to leave)
So any helpful advice, similar situation can help.
Thanks a lot in advance!
Custody (non-married)
Re: Custody (non-married)
Unfortunately doesn't say much...
Common-law and custody... In which case it applies ? From what I read, there isn't. Yet, some people tell me, we do have one.

Maybe you should contact lawyer. http://lapsilaki.fi/huolto/ does agree that you have a sole custody. Reach out to them?
