I and my husband are not EU citizens but we have permanent residence permit in another schengen state. Our minor children are EU citizens. We have applied for residence permit of EU citizen family member and we got a negative decision because I and the children were not in Finland during the processing time but my husband was living and working in Finland through out the processing time.
Shouldn't you rather register your right of residence as family members of EU citizens (the children) using their free movement rights?

My children have gotten admission in the primary and secondary school in Finland for the academic year 2019/2020 and they will resume in August 2019 so we are moving permanently to Finland soon. Can I re-apply for the same type of resident permit if I choose not to appeal the decision?
It's possible to re-apply but don't expect different results with the same input.

We actually tried to register our right of residence as family members of EU citizens (the children) using their free movement rights, but we were denied on the bases that the children and I were not living and studying in Finland at the time. Meanwhile my husband was living and working in Finland as self employed person with sufficient income for the family. My husband was also refused and was asked to leave the country and he is willing to leave voluntarily.
My question is, can we all go back to Finland and re-apply again since the children are going to start living and studying in Finland from August?
Yes

This is a very serious matter if he has a deportation notice. I suggest that you contact the police or a lawyer directly. Taking advice on something like this from strangers on a forum is asking for trouble.
