Divorce with a child residence permit
Hi all
Im non eu and my wife is finnish we’ve been married for 1.5 years and i have residence permit on family ties
We have baby and im not working im about to finish the integration program
Lately our life is becoming like hell mainly because my wife is kind of bored Of our relationship and she starts to drink heavily And go clubbing every week and alot of things that we didn’t agree on from the beginning
We decided that we have to divorce and she wants to keep the baby but i want to keep the baby Also And go back to my country to get married again but i think that cannot do that
My question is what will happen to my residence permit after divorce and I cannot imagine that I would be deported so I cannot see my baby in years that is driving me insane !!!
Please help

After the divorce, you're still a family member of your daughter, so there should be no problem when renewing your RP.
But if you lose custody, things might get a bit more complicated. So go for shared custody.
It is unlikely you can keep the baby. In most cases, the child will stay with the mother. (unless the mother is judged incapable of taking care of the baby) The best you could hope for is a visiting arrangement.
Your position will become stronger if you find a job. So that should be your first priority. And don't burn any bridges toward your ex.

Feminism won't allow it.
Social and welfare benefits in this country lets women believe they can raise a baby by themselves and do not need a man.
My advice is to party along and make more babies with other women to keep your permit going.
Be the bigger pig.

Yes when custody = huoltajuus. Do note that custody can be shared even if child regularly lives with one parent. Based on this thread consider getting professional advice.
As a side note, it's interesting that Migri uses the term guardian on their website when Finlex translations use the term for "edunvalvoja". Seems like it would be better for Migri to fix their terminology.
