Hi, I just want to ask in behalf of my brother I hope somebody can help me. My brother came to Finland with tourist visa only on July 28,2024. During his stay since at that time before the new ammendments came into force, he was able to find a job in Finland and an employer is willing to apply for a residence permit for him based on work. So everything went fine with submitting the application but unfortunately we received the same message from enterfinland that the authority will contact him. It has been 5days from now since we received that notification from enterfinland then he tried to ask his employer and yes he was already informed by TE-palvelu that the partial decision was negative so as the final decision of migri. I want to ask if we will make an appeal how much is the chance that they will reconsider my brother’s application? How long will the appeal be processed? And since employer is the only one who is allowed to make an appeal to TE-service what if employer doesn’t want to make an appeal anymore?

By the way my brother applied as a cleaner and the reason why TE gave a negative decision it’s because they assessed that there’s enough labor here in finland for cleaners

Yesterday in the news:

That would make it hard to convince a court that the assessment in the partial decision was wrong.

Does your brother have some special qualifications in that field that made the employer wait for a residence permit instead of immediately hiring some unemployed person?
Special qualifications above what the typical cleaner has (and accordingly a higher salary) could be a reason to argue that the decision was wrong.

Hi thanks for the response. The employee already sent an explanation to TE about it that they have a lot of applicants but my brother is the one qualified for that position especially working night shifts, weekends, and from one place to another and yes thanks for sharing this news this made me really confused if there’s a lot of demands for cleaners but matching them up can be difficult why they didn’t accept my brother’s application if the employer really thinks he is the right person for job.

But then before we make an appeal we still
Need to wait for the documents and the instructions for appeal we only know about the partial decision but basically if partial decision is negative so is the migri. It’s so hard to wait and worry at the same time if they already made a decision why not send it right away so we can decide if he will go back home or stay and make an appeal

Hi I will expose my case and please guys let me know if this is normal, i applied for family ties and i got information that there is a suplementary information requested (so they send some questions to me and also to the mom of my son, due the residence permit is based in my son as legal custodian that i am), but at the same time they send a note that The decision will be served on me by the authorities. Please wait for the authorities to contact you.

Is normal to have the same message of migri asking for the suplementary information and also the same time saying that the authorities (that usually is the police) is the one who will contact me and knwing thats because a posible negative desicion? many questions arise, the can have a desicion even before they send the suplementary information that have a deadline in my case and the mother of my child of 15 days to reply?

The last communication was on May 17, and you're supposed to "wait patiently"? Something doesn't make sense here.
