Changing the ground of the type A permit

Post by agashaw » Thu Oct 28, 2021 10:50 pm

Hei all,

I have a type A residence permit for cohabitating partner. We've been together for a very long time, but we're thinking about going our separate ways because, after all, we might not be a good match. This happens, but at least we're finishing on a pleasant one, with no bad blood.
I'll have to reconsider my permit type right now. I'm going to change the basis to be based on employment. I'm employed with a permanent contract.

Here's the question,

My permit is about to expire in less than a year. Will the three years out of four years still be considered if I change the ground? Or will I have to wait another four years, starting now, to wait for a permanent permit?

Another question is whether current employment (not including past employers) must be for a period of more than one year when applying on the basis of employment.

I looked at Migri, but it seemed a little vague to me.

Thanks a lot in advance.

You have to be uninterrupted on A, whether grounds changed does not matter.

The minimum requirement is a signed employment contract.
A common case is that the applicant from abroad is not allowed start working before the residence permit has been granted.

Unless you are a specialist, the one thing that usually matters is the decision from TE whether you might be taking a job that could be done by an unemployed person instead.

Thanks a lot for responding.

He moved out in the summer. We were thinking about getting back, but this is what happened. My A visa was granted since I had a cohabiting partner. After putting things together, I'm trying to switch it to an employment-based visa. I had a lot going on at work.

Will the gaps which have been up to this point will cause an issue, when it comes to change the grounds? Or, if I want to, getting the permanent visa in the future?

Also, should I file for a new employment visa(TTOL, extended not first permit) after canceling my previous extended permit that I had for three years?
Or should I present a document proving that I have other ties to Finland (a job in my case) without submitting new application?

With so many things going on and changing in my life, my head is feeling a little cloudy, so I wanted to double-check. I also emailed Migri about it, but have yet to receive a response.

Cancelling your current permit would be a very bad idea, it would immediately remove your right to work.

A formal change of the grounds, including TE checking whether or not a residence permit should be granted for this job, requires a formal application.

Migri should be able to tell you whether you have to apply for an extension immediately, or whether it is sufficient if you apply in time before your current permit expires.
