You should attempt to call him, tell him that you will make the police report and give him one last chance to send you the money back or the phone.
If he fails to complete the deal. Report the guy, share the police report with the guy who scammed you. Maybe it'll convince him to actually send you the phone or your money back. Remember to report him to Tori after filing the police report.

I’m sorry to hear this happened to you. Please make a police report. They won’t do anything quickly but they will investigate.
