Getting Married in Finland

Hi,

I am having a problem that i don't even know how to start it .. I got married in France years ago, and obtained a divorce judgement in november 2012 (agreed divorce from both part). I have tunisian origin, and whenever i tried to register the wedding and after that the wedding and the divorce in Tunisia, nothing changed, they told me that the issue is from the Tunisian embassy in France, and in France they told me that everything is sent to Tunisia and they can't do anything. And there is no way to register a wedding out of the tunisian border unless you pass by the embassy. Anywho, Actually i am considered as single in Tunisia, (i even got all the papers needed with stamps from all the minstry needed and from the finnish embassy there) and i am divorced in France. And in order to get married with my finnish partner, the finnish office is asking for my civil status from my country of birth and origin.

The only way i can apply to get married in Finland is to declare that i am single. And nothing is moving forward in France nor in Tunisia. I am stuck in between, and scared from the fact to apply to get married here and be crossing red lines. It's been 2 years that i've been trying to settle down in Finland, cause she can't move abroad for the moment. And we are tired from living 3 months together and 3 months away from each other which is taking money, time and energy.

Would it be a crime to apply to get married with a single cetificate stamped by all the needed authorities ? what can i risk with this step ? i will claim that i am living in France and on that base i can be in Finland without a Visa to get married. I am a bit lost ..

not at all, cause then it's gonna take forever for things to work and i can move here

So, what is the problem?
You are single in Tunisia, you do not live there any more, so its natural you are single.
You are permanent resident in France, you have a paper of marriage and a paper of divorce from French authorities?
So, whats the problem? You have all the papers?

I don't really understand either. Foreign marriages are just as valid as marriages in Finland.

From the Marriage Act:

Section 115 (1226/2001)
(1) A marriage concluded by a woman and a man in a foreign state before an authority
of that state shall be valid in Finland, if it is valid in the state where it was concluded or in a state whose citizen either spouse was or where either spouse was habitually resident at the conclusion of the marriage.

So for moving here it doesn't matter where it happened. Regardless, if you want to get married in Finland, just take all the paper work you have to the local registration office and be honest. They will tell if it is enough and like the previous poster said it looks like that.

The problem is that with a permanent resident you are still having the passport of the country where you was born, so any official paper should get out from there (even a birth certificate) and it needs to be translated and all that jazz. the whole mess is that the tunisian embassy is not doing the right work in France, and i should get a paper from Tunisia which is saying that i am divorced (not the single paper that i have now which means that i never got married). I can take whatever papers to the finnish office here from France they won't take it in consideration, they will just then postpone everything til my things get solved somehow..

I think the non marriage cert from tunisia is the correct one.It proves you dont have any marriage in your place of origin.

that's what i will try .. but in case they check the french office, i think i may be in trouble cause i don't know if they consider that as "cheating" .. anywho ! birds and fish can get married easier than a human who think he owns them

Lets exchange the word "marriage" to "prison", its close enough.
You lived in Tunisia for 20 years and moved to France. You were a good boy and out free. OK
You lived in France for 20 years and were a naughty boy and was in prison. OK
Does this prison sentence magically appear into your Tunisian criminal record? NO
Does your no criminal record from Tunisia count for time after you left Tunisia? NO
Do I want to see a certificate of the French authorities if you have been a naughty boy? YES

It's the finnish office who is asking for those papers. So i think there is a difference between the prison and marriage (^^) .. Ususally countries have links between each other so if you are from country X, who got married in the country Y .. the country Y is contacting the X(an) embassy to inform .. that's a case, and in other cases you need to take the papers by yourself so your marriage or divorce can be registred in you country X .. The tunisian embassy should have done that .. but still, i took all the needed paper TWICE !!! .. and no changes .. anywho ..

The finnish office is wanting to know if I got married before and what's the name of the ex-wife etc .. but they want it from Tunisia as i am having a Tunisian passport .. and in Tunisia i am single according to the law; so or i will have to lie in the finnish papers that i am single and i had no wife before, or to say i had a wife before .. but then i need to prove that i am divorced .. FROM Tunisia !

You think like your country and your country is crap, end of story.

You have a non marriage cert from tunisia proving you were never married there .
You have a marriage and legal divorce cert from (who cares country).
Thats what any normal gov needs.
Why dont you download the application and look at what questions they will ask.

Care to clarify? After getting married (and divorced) there once, the second time would be a worse hassle?
This assuming the Finnish authorities want a paper you can't get.

You have a marriage and legal divorce cert from (who cares country).

Why dont you download the application and look at what questions they will ask.

if you are not able to understand the situation you don't need to answer and show disrespect! i downloaded everything and i filled it .. that's why it's frustrating .. whatever, thanx for your effort!
