Child visitation issues. Help, need info

Hello good people :)

I am looking for info. This is my issue... I have a baby with a Finn, whom we broke up after about 5 months of the baby because he was a drunk and abusive, so i moved out. I never contacted the police about his abusiveness as i thought moving out was good enough solution.
Living alone but he continued to be verbally abusive and threatening me and breaking my stuff when he visited my home so i banned him from coming to my home and he can see our baby on public places. His behaviour was terrible so i asked for a sole custody at the child services, he said no at first and were about to go to court when he changed his mind and gave me sole custody..awarded at the child service not the courts.

During the time we agreed on visitations but he only shows up when he feels like or its "easy" for him as he puts it. His reasons range from he doesn't have a car to Its too difficult on weekdays, again because he doesn't have car which he can get weekend from his mom.
At some point i blocked him from my phone because we couldn't a few weeks before he insulted me..which was getting into me and we now only communicate on email about when he can see baby. So for this reason he claims i have blocked him from the baby, he has lied to his parents that i deny him visiting which is all a bull and they won't believe me when i say its not....why would they!

Anyway, his mother is pushing for a court so they can make it that he can take the baby for weekend at his place, which i am against. He is not entirely into the court thing but his mother is keen on it..Because apparently the current arrangement isn't working even though i have given him freedom to choose the day he wants to visit baby but he just wont unless its easy for him or i take the baby to him. He say if i unblock him he might drop the court thing but i don't see this happening because i can not endure more of his insults which comes at the slightest provocation, i need my sanity!! and of course this he interprets as me being proud.

This is the case and now i need any info on where can i get a lawyer and what are my chances considering am a foreigner¨... i have heard from him and also other people that courts here tend to favour the natives. Also to mention that he is bragging that he has a big lawyer and he is sure am losing. Am not exactly sure if he wants to reverse the custody or just the weekend overnight visits, but am wondering can they reverse custody?
I have no qualms with him visiting baby, but what i am not agreeing is overnights, or him alone with the baby...i just know baby is not safe with him alone, and not even when the mother is there because they are constantly fighting and arguing. With his father and step mom its ok or me...as the previous agreement also says, that he can be with baby when am there or when he is with parents, never alone(mind you that part is expired it needed renewing but he left.... now he is back demanding overnights.

You need to go see the child lawyer. I can't remember the name. Lasten..... Something.

Document everything clearly and factually. They will help you because they are representing the child, not you or your ex. So technically should be impartial to you both.

The Inlaws shouldn't be having any say in anything.

If you are being threatened and afraid for yours and your child's life, go to a women's shelter.

Of course you should unblock him - and set a recorder application to your phone. That is perfectly legal and you do not have to tell him that you record his calls.

Hi Guys!
Thanks a lot for your helpful info. We are not living together or allowed to come to my place anymore so that put a stop to his violent tendencies, save for 2 months ago he showed up in my door step with the mother and when i asked him why he is there and they both know he can not come to my place he tried to hit me but they left when i said i will call the police, now do i need to contact the abused women place if its not currently going on?

Another question is, when do i need to contact and apply for legal aid? Shall i apply it now before this man has made up his head that he is going to court, or shall i wait and when he contacts the courts then i contact the legal aid place?

Contact them immediately. They will tell you to get back later if that's the best way to proceed.

You do not need a lawyer assigned to you by the court, you can contact a private lawyer and he/she will tell you right away how much you'd be expect to pay, here's the calculation sheet:

I'm almost sure that you end up paying the same for a private or for an assigned lawyer (someone please correct me if not). However, you can not pick an assigned lawyer; so you may get someone incompetent.

People who do not get their way will always moan and bitch about this or that. If there may be a foreigner handicap (your ex using it in court doesn't mean that the judge will take it into consideration) it's probably much smaller than the real discriminant: gender.

I did not pay for a lawyer. I used the child's lawyer. It was for free.

You pay the same if you have income/assets. Otherwise legal aid is free or at least cheap.

Unless you have assets the legal aid will not bankrupt you. They will make a decision on your eligibility and payment level in initial meeting. You will have an idea about payments before you have to commit to anything.

you should definitely contact the monikanaiset, what tummansininen suggested earlier.
they will help you.

in any case, i never heard of a "child lawyer", but a resident of finland is entitled to legal aid regardless of income, aka oikeusapu:

Well, I use to live in Nurmijärvi and I went to Hyvinkää, where I had a lawyer for free for my child. It was not legal aid.

She represented my child in regards to child support, custody etc. Her interest lied solely in what was best for my child.

The poster here should also be able to get the same type of lawyer in her city. She shouldn't need to go to legal aid.

It was for free. I didn't have to fill out any forms regarding money, what I earned or anything.

Be aware that what you think is best for the child may not be the same as what the lawyer thinks.

Since contact with both parents is considered important for the child, his visitation rights will not be revoked.
If his behavior is questionable it will probably be supervised visitation. But it might not be you who's doing the supervising.
If he presents his case well, he might just get what he wants; visitation with his mother present.

She probably asked you about your income and expenses? Private lawyers can take care of these for their clients and request oikeusapu on your behalf.
If you check the form I posted above it will an idea of what to pay (single parent with no income =0)
