Re-entry while awaiting first residency permit

Post by malongo » Sun Apr 09, 2006 11:45 pm

Anybody know where I can find rules of re-entry while awaiting a residency permit decision? The scernario would be:

-a US citizen (me) applying as family of finnish citizen (my Finnish bride-to-be)
-I would be leaving Finland after 60-70 days (of application) for the US for a wedding
-then (hopefully; this is the questionable part) returning to Finland after only a month abroad

As far as i know, the average wait time (posted on uvi.fi) for a res permit as family-of-finn is 4 months. I've heard this can take far less time if in a smaller town - I'll be in Lahti.

Additionally, I believe there is a wait time for returning to Finland if entered under the Schengen Agreement. I could be wrong, though... It's hard to keep everything straight sometimes.

I see that I may STAY in Finland if I'm awaiting the decision, but I don't know about leaving and coming back. This is all moot, of course, if I can return to Finland under Schengen whenever I feel like it, OR if the wait time is shorter than advertised.

Any info and/or direction-pointing would be greatly appreciated!

Under the new Aliens Act this is no longer a problem.

Simply request a return visa at the local police station.

The relevant statute is paragraph 3 of section 30 of the Aliens Act.

I recently obtained my residence permit through marriage, but while I was waiting for it to process they had my passport and asked that I stay in country. There may be a way around this. Also it took about 9 weeks for my permit to be processed.

I am currently waiting for my first permit to go through and I told them about a trip to Sweden I had planned. They said that it's not a problem to get the passport back and I just have to return it when I get back.

Finally, some good news on the forum! It's my brother's wedding, and I don't think either of us would be very pleased to hear that I couldn't make it because of a technicality in the immigration process. Thanks for the replies
