And if files the dang appeal letter instead of sitting on it, he'd have the
time. If they're planning on getting married in the summer, there's
no reason for them not to do it in a civil ceremony now.

(I wrote most part of this message before lunch, and thus haven't followed the discussion lately. Anyway I post it here.)

At the risk of being totally wrong without knowing the details in your case, I would say getting married will only give you the new ground to file a new residence permit application. It won't change the result of current permit decision when you appeal, since the fact of your being married comes after the decision is made.

You can stay in Finland legally, albeit without a permit, up to the point when the decision becomes final. So if you appeal the decision to the administrative court, you can "buy" yourself some time to stay in Finland legally. If you get married soon and file for a new residence permit application, it is possible that you can get the permit before the court gives a decision to your appeal.

Of course, you can also decide to leave Finland voluntarily before the negative permit decision becomes final to avoid the possible deportation. This shouldn't affect the possible future permit application, since everything you've done is legal.

The thing that you can't come back to Finland for x months could due to the visa waiver program between US and Schengen countries. AFAIK, Americans can stay in the Schengen area visa free up to 3 months in any period of 6 months.

appeal is filed!...

So Sy..."it wont change the result of the permit decision", and I can reapply if I marry now, but will I still have to go back first?

...and filing stuff on top of pending stuff seems to me to be asking for more trouble. you said "before the negative decision becomes final, I assume you mean the appeal decision?, or is there a lapse between the permit.(before the appeal) denial being given to me and it becoming final?

OK, lets put it into an example an American might be more familiar with.

You are on death row now. You just appealed for a procedural error in your arrest, they didn't miranda you proper. Its going to boomerang. Unless you can get the case reopened with new DNA evidence, you meet old sparky. :twisted:

Yes I admit, I watched all too much matlock on TV during the week I was sick in bed. :lol:

...but my counsel has so many cases! and it appears that the warden(UVI) doesnt want me aquited because i'll marry his daughter!


whew!..sometimes a humor break is a nice change from all this =¤%&!

so now my appeal is filed, letter of recc. from employer, letter from fiances parents, language class certificate, etc...seems I'll still be headed home though, I inquired about the port of call, since I live in California, no reply from UVI and U.S. embassy sends me a form letter about 90 day stays in Shengen countries, I wonder if I'll even be informed of my appeal decision or the poliisi will just take me away to the airport...which reminds me, when do I get my passport back? At the airport? Im nervous, scared, pissed, dissapointed and tired.....

The Aliens Act Section 49 says:

(2) A temporary or continuous residence permit is issued on the same grounds as an equivalent permit applied for abroad.

First of all you will be escorted to the airport then to the air plane,then from there,they will give your passport to the Captain or cabin crew of the airline that you are flying to the US,then when in the first port of entry in the US,you will have to pass by the US Customs to answer some question,then you will have your passport back.Well this is what happen to me when been couched illegally wondering around the streets of Tokyo before.
Well i am saying what it happened to me,but i am Brazilian.I don't know what they would do in to you in the the US

Well, they will call you about your appeal. They will tell you that you have to purchase your plane tickets and bring them to the person in charge of your case. They will tell you that if you show them the tickets that they will return your passport to you. They will not return it. You will not see your passport until you reach America. They will make it seem like it is no big deal. Once you arrive to the airport, they border guards will escort you to the ticket counter, and take your tickets. They will escort you to the airport police station where you wait for the flight. If they are in a good mood, they may allow you to walk around. When your flight arrives, they will escort you to the gate and watch you leave. If you have a connecting flight, you might have to stay at the airport jail until you next flight arives. Oh, I forgot, before you leave finland, they may take you picture and finger prints. They will tell you that it is better to purchase your own plane tickets. If you do, "things will be better".

my god, what a complete waste of taxpayers money! So I'm basicly a threat to Finland because I want to live here. well anyway, now that my appeal is filed my "caseworker" called me to come in and see him monday after next, my fiance talked to him about some things and he told her to call the immi office and give them some "dont send him back" statement and appearently,according to my"caseworker", it will buy me more time..up to 6 months...appaerently :?
