Divorce Question

Post by peteh » Mon Jan 21, 2008 11:11 am

Here's the problem. My ex and I broke up approximately about a year ago. We slowly separated and sold our house about August Last year. All our assets where split 50/50. I signed a divorce paper from her before that process took place. June/July.
Now my son lives permantly with her but spends a great deal of time with me, we decided to have no custody battles over that situation and everything concerning my son is ok. In the meantime she is renting an apartment, whilst I decided to reinvest my money and by a new apartment.
Now I have heard nothing from the magistrates that the divorce is finally finalised, so after speaking to my ex. it seems that she did not file the papers after I signed. !!
I now have to personally get the ball rolling, so it looks like another 6 months of waiting .

Now what is my legal situation when it comes to ownership of my property? the loan off course is in my name, but could she be a bitch and demand half?

Also what happens when the divorce is completey finalised, do I need to re-apply for a residents permit?

Thanks in advance. Peter

You own your own property, whats women got to do with it? As for the residence permit, well, you're a limey, right?
Cheers, Hank W.

Peter,
Divorce routine is
1) 1st application
2) Notice of application to spouses
3) 6 month wait for reconsideration
4) further 6 month window to make 2nd application
5) if 2nd application received divorce will be granted, if not sent then 1st application will become void after window closes

Check the dates on the papers you have filed/received - is the 2nd application window still open after all?
More to the point - how do you interpret her intentions for not sending the papers?

Good luck.. whatever that might be! 8)
I am not a number!
