regarding work contract termination
Hi, friends here,
May I ask for some suggestions?
I am currently working here in Finland in the local company with the OY type. And in the contract, the principle duties item writen: Myynti ja markkinointi kaukoitään ja ulkomaille. I have been working in this company since 2005 in March. The work regular working hours is 8 h / day, and 5 days / week. Contract is permanent job. Collective agreement applied in the work is TES. Today, the employer talked with me that he wanted to terminate my work contract.
I am wondering that if it is so easy just to terminate my permanent contract? He mentioned that the economy situation was not so good, and nowadays because of the inflation, the salary and pension things were too big cost.
And later on, what kind of conpensation can I get from the company or employer?
Many thanks in advance!
Regards,
Henrik

Hello, what is the period of termination (did he say when you have to leave the building?).
If the termination is economically (the magic word) there is not much to do but contacting the lawyer from your union and explain it. Thanks to all these wunderful unions here in Finland there is nto my idea not much to do. Maybe the lawyer gets something out of it for you but if you have to go to court it takes at least one year. In another thread I said that we will get more of these questions

Redundancy due to "economic situation".
Dont expect much from your employer.
Check the terms of your contract on "termination"...
Look for words like..
irtisanominen
irtisanomislauseke
nimittämiskirjan peruuttaminen
My guess is it is probably minimum of 1 month, and on rare occasions up to a max of three months pay, then moi moi.
Hope you have been paying into the unemployment insurance fund.
It is mentioned in this thread..

Note that it is a fact that one must pay/be a contributor to the fund for a minimum of 10 months to qualify.

You're getting laid off rather than terminated, so if the employer has "productional and financial" reasons thats then thats a reason for layoffs...
Compensation? You go to KELA and sign in as a jobseeker to get your unemployment benefits.

Thank you all for your kind answers.
Yes, I checked and got the result that termination of notice period is one month when working period is more than one year and less than 4 years in our industry.
According to accoutant statistic, my sales for the company in 2005 covered 80% percent of company's total sales value, in 2006 covered 65%, in 2007 covered 40%. I think that one reason might be the sales were decreasing every year, the company was losing clients every year due to higher quote. On the other way, the employer believed that all current clients I have brought to the company were already loyal customers. He did not need me any more.

I am wondering do I need to sign some kind of paper regarding the work contract termination? Also if my employer should sigh some kind of paper in order to certify that I am leaving the company on the specific day?
Thanks a lot.

Re: regarding work contract termination
well you should have your termination in writing? if nothing else you are obliged to be given a työtodistus, basically a paper saying that nnn worked from x.x.xxxx to y.y.yyyy in the position of xyz ...it helps with KELA if it says you are terminated, but they need to put a valid reason there "like the productional and economic reasons" or whatever... but a paper stating that is as your pay stubs - its automatically given with very little leeway in its form.

Re: regarding work contract termination
Ask the employer to write you a "työtodistus" that says you were laid off "tuotannollistaloudellista syistä". It will state the time of your employment.
Re: regarding work contract termination
Also, it would be very advantageous for you in the future, if you get a recommendation from them as what you stated was your contribution and the reason for your layoff.
Also, contact unemployment office and your unemployment Fund/Union once you ge the letter in writing.

Thank you, EP and raamv.
The employer told me that I belong to the TES union. Do you have any idea what kind of union is it? If there are any web links regarding this union?

Re: regarding work contract termination
TES isn't an union, its the(any) union contract... if you haven't belonged to an union (gotten any union magazine, membership card etc?) and paid fees to the unemployment fund then you're in deep doodoo
