im a foreigner living in finland my problem is last month but one i was traveling abroad, on that night i was given a penalty ticket(i had left my ticket at home as i was traveling) by ytv ticket inspectors. i talked to those inspectors and thy told me i could come cancel the penalty ticket when i came back(she wrote this on the back of my ticket) when i came back one moth after and tried to cancel my ticket thy said its not possible to cancel it and that i have to pay 90€ for it. at this point i threatened to get a lawyer but the lawyers are too expensive for a student like me. Now thy say thy will take the money out of my tax return.

now what i want to know is:
1. is it because im not Finnish that thy did this bcause i know one of my finnish friends and her penalty ticket had taken more than 2 months n she was able to cancel it or what is the deal here??

2. why dont this pple want to reason because i had paid my monthly ticket and it shows on the day i was given that ticket it was still valid.


could some1 pliz advice on the course of action i should take here because this is clearly UNFAIR AND UNJUST

On the YTV pages it says this

Maksun mitätöinti voidaan tehdä viikon kuluessa maksun määräämisestä.

In other words, if you have a valid ticket but have e.g. accidentally left it at home, and you are given the penalty fare to pay, then you have one week to go and cancel the penalty fare.

I don't think you have a case, unless they are willing to make exceptions on the grounds that you were away for a month and that was absolutely the earliest you could go and cancel the fare. You'd need to prove that to them somehow, of course. Try and argue with your friend's case, take her (along with PROOF of that 2-month delay being ok by them) with you and talk about it. Also try and make them contact the original inspector, who wrote the note on your ticket.

In the background, keep calm and try and see their point of view as well. I can't even imagine how many creeps are trying to wriggle out of paying their penalty fares on dishonest grounds, so thanks to this bunch the staff are hardened and cynical at times, even towards those customers that really do have a plausible explanation.

IMO the last thing you should do is to resort to silly "you're only doing this because I'm not Finnish" tactics.

Did you go in person to get the refund when you came back or did you make the claim in writing?

I suggest you get someone to help you write a letter, in Finnish, explaining the situation and stating clearly that at no point were you infringing the law or had any intent to do so. Send them proof of your absence from the country.

When you get a reply from them, if it is negative, you could go to the consumer ombudsman to make a complaint, I don't think that costs anything.

But, as said above, if you are outside the one week limit then legally you don't have a case.

Believe me when i say i have tried all this. The only thing i have not tried is probably Running in their office like a mad person demanding Rights Then again that could get me Arrested.

Isn't there smone else here with another great IDEA.

I might have - but it will cost you 90€ :wink:

Please understand that unless you have clearly written (verifiable) proof that you have been "promised" an extension beyond that one week by ticket inspector X, you do not stand a ghost of a chance. If you do, then all you CAN do is negotiate - either directly with YTV or as penelope said, kuluttaja-asiamies - see also http://www.kuluttajavirasto.fi/ . Simple as that.
