I would like to find out how is possible to obtain a child support for my child.
I am an American citizen and live in USA and the father is finish citizen.
The child was born in USA,(after we were divorced).
He recognized the child and the child is living with me.
Is there any way for me to make child support amount to be decided by the court of low so it will come regularly and in correct amount so I don't need to ask the father constantly about that matter.

Re: child support from finnish man
Do you have some court order or (in USA) legally binding agreement with your ex-husband about the support, but he likes to skip paying? It would seem the starting point is to have the local courts here (specifically the Helsinki area appeals court) to confirm the earlier USA decision

http://www.finlex.fi/fi/laki/ajantasa/1983/19830370Päätöksen täytäntöönpanoa pyydetään kirjallisesti Helsingin hovioikeudelta. Hakemus voi koskea myös päätöksen osittaista täytäntöönpanoa.
Hakemukseen on liitettävä:
1) päätös alkuperäisenä tai viranomaisen oikeaksi todistamana jäljennöksenä;
2) todistus siitä, että päätös voidaan panna täytäntöön siinä valtiossa, jossa se on annettu;
3) kun päätös on annettu poisjäänyttä vastaajaa vastaan, alkuperäisenä tai oikeaksi todistettuna jäljennöksenä asiakirja, josta ilmenee, että haaste tai kutsu, jotka sisältävät 7 §:n 3 momentissa tarkoitetun ilmoituksen, on annettu tiedoksi sen valtion lain mukaisesti, jossa paatos on annettu;
4) milloin hakijana on viranomainen, asiakirjat, joista ilmenee viranomaisen oikeus pyytää täytäntöönpanoa;

Re: child support from finnish man
I don't have any court order. That is why this is very difficult.
We went to Finnish embassy so he can recognize the child so he can receive finnish citizenship.
The child was born 3 yrs after we divorced and when we divorced I did not ask for any support, so nothing legal...

Re: child support from finnish man
If he is not paying voluntarily and you have no court order to order for to pay, then you need to get one. AFAIK (and I certainly am not a lawyer) you need to do that in your local jurisdiction, after which you can then ask Finnish courts to find that decision enforceable also in Finland.
Re: child support from finnish man
OK, so I am back to zero again. Do you think that I can go directly to Finnish court without going to the local jurisdiction? because I don't even know who to ask here.
Re: child support from finnish man
That is of very little use I'm afraid. In cases like divorce and so, the Finnish system let the local jurisdiction and rules prefail.angel1 wrote:... Do you think that I can go directly to Finnish court without going to the local jurisdiction? ...
So you really have to arrange things in the US first. A Finnish court would reject your claim because there is nothing you can base it upon.
Re: child support from finnish man
Normally the local child support staff will assist custodial parents to file a petition in Family Court to obtain a child support order. If the Finish Embassy doesn't give you answers, contact your local Child Support Office and ask.
