pregnant+work contract

Post by jasmine4 » Mon Apr 12, 2010 8:50 pm

Hi!
I kindly request for some advice, or for someone to shed some light as to what steps to take..My situation is that iam currently working on a job that has lasted three years, but is to end soon.As my employer had already made me aware of this, i embarked on searching for a new job, and just recently, got a new job, beginning two months after the current one ends;and we have signed the contract.Couple days ago however, ive found out that am expectant :D , however amidst my absolute joy, am a bit confused as to how this will impact my next job, or even contract? The newly signed contract is open ended, but by the time i begin it i will probably be able to work only three months before going on leave.
Am wondering, is there any possibility that my contract may be cancelled? Should i rest in the fact that i have a signed the contract and inform my future employer or shall this backfire on me? Iam afraid of finding myself without a souce of income/job..way too early.
Has anyone been in a similar situation or even close? Any advice as to what to do in this kind of situation?Iám not sure if its of any relevance , but in addition to this, ive been a member of the Work union, and hold an A permit.

I will appreciate your feeedback, thanks.

You are not obliged to tell you're pregnant. And the boss should not ask about it.
So that is no reason to terminate your contract.
But from what you tell, I suspect your pregnancy will be visible during the first few months of your new job.
That makes it possible (or even likely) to terminate the contract in the probation period.
Anyway, if the boss is not happy, he'll find ways to get rid of you sooner or later.

Mostly. A few points though:

She is supposed to tell her employer two months before she intends to start the maternity leave.

If (or when) she tells and her contract is then subsequently terminated, it is the employers responsibility to show it was NOT because of the pregnancy. Probably they are quite eager to find a reason, but sometimes these cases are taken to court and even won. When you approach the point where the pregnancy can not be hidden it is best to tell (in a way that can be proven) about it. It is for the benefit for the employer if they can say "we did not even know she was pregnant when we decided she was not really for the job..."

She says she is member of a trade union. I suggest she looks at their website for the contract info of the union lawyer.

They can't end your contract on the basis of your pregnancy and you should tell your employer two months before you intend to begin your leave or before if you want to. In your case I'd be more inclined to tell my employer since it makes it more difficult for them to terminate your contract on the basis of 'other' issues and claim they did not know about your pregnancy, e.g write an email to your boss and print it out ;-)

No, but if the OP is on trial time, they have no obligation to prolong the contract either. And they do not need an excuse for not prolonging it.

Even if she is on trial time it is a question of terminating the contract, and yes, if asked, the employer need to supply a reason for that and while they have lot of freedom here ''she is pregnant' is not an acceptable reason (employment contracts act chapter one, section four and chapter two, section two, the non-discrimination act referenced there and penal code chapter 47)

Her position is weak, but she it is not completely with out any legal safe guards.

Congratulations :D

You are not a liberty to tell them that you are pregnant but obviously if you are showing then it will be pretty obvious and you will have to. I don't think that they can hold this against you as when you signed the contract you did not know that you are expecting.
