Which RP do I get based on family tie?(A or P)

Post by bazargan » Thu Nov 10, 2011 9:50 am

Hello

I have been married to a Finnish citizen and its been two years we are legally married.

Information about me:
male, 24 years old, Iranian citizen, residing in Iran, business man.

Information about my Spouse:
Female, 24 years old, Finnish citizen, residing in Iran, studied in Helsinki university,

I love to move to Finland. but the problem is that my job doesnt let me stay the whole year in that beautiful country. Im satisfied with my job(trading preciuos stones). So I am a bit confused about changing it.
I am applying for a schengen visa already. Thinking about applying for a RP also is an option for me. A Few questions are bothering me though;
here is the questions:

1. What type of residence permits do I get if accepted?( A or P)
2. Do I get Multiple entries Schengen Visa?( I like to visit all the jewelry exhibitions held in EU)
3. Do I have to enter Finland after I get Schengen Visa? Is it against the law if I use the Schengen Visa I get based on family tie to enter only other EU countries? for example I use my Schengen visa only to travel to Italy for my job.
4. Does my spouse need secure income for my RP?
5. If I get continuous RP, can I extend it being jobless in Finland? ( I am self employed. so does Finland accept it as a job? if so , how should I prove to them?)
6. How long is the period I have to stay in Finland each year to get qualified to extend the RP if having continious RP?
7. Do I have to learn finnish language to get RP?

I apologize for my English.
I really appreciate any help I can get on solving these questions!

Bazargan,

I can't answer all of your questions, but you are not going to get a RP for Finland (Schengen) unless you actually move to Finland and live there (registering to live, staying the majority of the year, etc). So staying in Iran but visiting Schengen is not a valid reason for getting a RP to Finland.

'A' first, you could apply for 'P' after four years
2. Do I get Multiple entries Schengen Visa?( I like to visit all the jewelry exhibitions held in EU)
With RP you don't need a visa. I do not know really about getting VISA based on family ties without RP.
3. Do I have to enter Finland after I get Schengen Visa? Is it against the law if I use the Schengen Visa I get based on family tie to enter only other EU countries? for example I use my Schengen visa only to travel to Italy for my job.
If you have RP in Finland you don't need visa for Italy. I'd think you'd be supposed to visit Finland too if you are using a Visa for Finland, although I doubt that is monitored actively.
4. Does my spouse need secure income for my RP?
No
5. If I get continuous RP, can I extend it being jobless in Finland? ( I am self employed. so does Finland accept it as a job? if so , how should I prove to them?)
As a family member of Finnish citizen you would not need to find a job for extension of the permit.
6. How long is the period I have to stay in Finland each year to get qualified to extend the RP if having continious RP?
I think they'd want you to have spent at least half of the time the previous permit was valid, but I am not sure about this, it might be more relaxed standard for new temporary permit. "At least half of the time" is the requirement for getting a permanent residence permit eventually.

A spouse of a Finnish citizen gets initially one year 'A' permit and then typically a four year permit after that. After four years of residence one would come eligible for applying permanent permit or citizenship.
7. Do I have to learn finnish language to get RP?
Only for citizenship, not for RP.

Question should be: "Do I need Finnish to survive in Finland?"
Answer should be: "If your wife does all the talking then not really but you must at least learn some level of Finnish. There is no test point requirement unless you want to get Citizenship but that is a long way down the line for you."

Is that just for Italy...? So I can go to Italy for a holiday on a Finnish RP without a visa?

As long as your spouse lives abroad, you cannot get a residence permit based on family ties.

Here's me assuming that she'll obviously come home with him though. But is there a time limit to which she must be back in Finland for before the OP can apply for a permit or does she just need to step foot in the country at the same time as he, or before?

The holder of a long-stay visa or a residence permit is entitled to move freely within the other state which comprise the Schengen Area for a period of up to three months in any half year.[81]

I assume he could apply in advance stating they plan to move to Finland at a certain future date together, even if haven't found that explicitly stated in any official source. The local embassy should be able to clarify that. She can have resident status of course directly after entering Finland by notifying the magistrate office that she is moving in. Problem for him applying only then are related to A) waiting time here before the application is processed B) the need to get also a Visa for entering Finland if he does not have residence permit already (two applications when one would be otherwise enough).

Thank you all for the greatest information you shared.
But some of the questions are still unsolved for me.
Thank you Rip and all for putting time in answering my questions!
Is there anyone in this forum that can help me on few other new questions?
A spouse of a Finnish citizen gets initially one year 'A' permit and then typically a four year permit after that. After four years of residence one would come eligible for applying permanent permit or citizenship.
1. According to what Rip said, does it mean that after I extend my first 'A' permit, I get a whole 4 year RP without having to extend it each year?

2. Do I get Multiple entries Schengen Visa?( I like to visit all the jewelry exhibitions held in EU)

3. I am self employed. So does Finland accept it as a job? if so , how can I prove it to them?(Bank account, etc.)

4. Lets say I dont apply for RP. Can I renew my Visa each 3 month by leaving Finland and applying again in my country?
I think they'd want you to have spent at least half of the time the previous permit was valid, but I am not sure about this, it might be more relaxed standard for new temporary permit. "At least half of the time" is the requirement for getting a permanent residence permit eventually.
5. Is there anyone who have more information that Rip about the period I have to spend in finland? Can I simply spend 6 months in Finland and the other 6 months abroad?

6. I have read that it would take one whole year to get RP. Is it so?

Sorry if Im asking too much questions!
Thanks again for your help.

Seems to be so.

No. Why would you? You can travel your ass of within Schengen area with RP.

You would probably have to incorporate yourself in Finland. There are some quite recent topics about it here. Read them.

I can't see why not. Seems expensive though.

3. I am self employed. So does Finland accept it as a job?
If your business is located in Iran, I expect it would lead to some critical questions. No way of telling if they'll accept it.
4. Lets say I dont apply for RP. Can I renew my Visa each 3 month by leaving Finland and applying again in my country?
If this happens on a regular bases, some eyebrows will be raised. If you don't seem to qualify for a RP, why should they give you an unlimited number of visa?

I can see why not, visas are for maximum 90 days in 180day period.
Also remember that you have to apply visa from country what is your main destination so you cant apply visa from finland and use it to travel to italy.

That is typical, but in principle it could be shorter time. I wonder if somebody applied on valid grounds, but when applying for extension it seems obvious that the family has been living largely or mostly abroad that the police would then give the extension but only for a shorter time (this is just speculation).

We don't really need multiple threads for your question, right?
