Indian national wife wants to move to Finland; I have RP

Post by sach_y » Thu Sep 13, 2012 11:32 am

Hi Group,
I hope with Almighty’s grace all are doing great.
I’m Indian citizen has arrived to Finland on First Finland Residence Permit which is valid till the year end and has the status ‘B’ on it and further will apply to extend it. I would like to get my wife to Finland. There were many ways suggested by some attorney general to reach Finland which are listed below. However I want to get my wife in Finland ASAP. Please help me into this matter.

1. Apply dependent visa in India for your spouse. But the processing time is very high approximately 6 months.
2. Apply for tourist visa in India and then apply for dependent visa after arrival in Finland.
3. Apply directly in Finland as a sponsor on behalf of your spouse, mention to send the documents to New Delhi embassy for further biometrics and personal interview of spouse.

Dear all requesting you to please suggest the safest and least time consuming process.

Indian friends who have already had gone through the same circumstances please suggest.

Thanks in anticipation.
Regards.

Visa is for visiting, up to three months; Residence permit is for residing.

For RP you have to have reason. Reason being: work, study, family ties.

1. is the way to go. 2. might be possible, but isn't how it is supposed to be done and the RP could be denied on basis of "applied in wrongly". 3. is outright wrong: "A residence permit on the basis of family ties can only be submitted by the applicant living abroad. The family member residing in Finland, i.e. the sponsor, cannot make the application on behalf of the applicant."

Visa is for visiting, Residence Permit for residing.

Hi Upphew,
Thanks for your response.

However 1. is the proper way but its processing time is around 6 months which could be adaped.

About 2. it was said by some is not possible and some said could be possible.

And regarding 3. it was mentioned in below link under (Family ties - Residence permit application for the spouse). If you read application form 15223_pk1_plus_en and 15093_ole_ph1_en . Some contents states that it could be possible to do.

Please suggest.

The law changed 2012, its the person themselves who needs to make the application after the fingerprinting came into effect.

As for almighty assisting you, do you make 1.530 after taxes? If yes, proceed, if not, then pray harder, the god you must worship is Mammon.

Also, when applying, remember that the dependent RP is linked to the sponsor RP - so they end at the same time and are the "same".

Agree with Pursuivant.
And to OP, the link that you have posted above suggest that your wife needs to do the application herself in India and what is required for you is to fill in and submit the form for the clarification of family ties. Six months could just be the time-frame that they are providing but if all requirements are met upon the submission of the application, then it could be less than that.

Being on a B permit and bringing your wife isn't a good idea. Wait until you get the A permit.

@ Logic; I will be applying for the extension but waiting for result would be good?

Guys I got what all mean to say. Also I got the information that your spouse can apply for residence permit from the home country and I have fill an application declaring family ties, accommodation details and salary details. And as stated in below link Q.11 she can travel to Finland during decision is pending and I believe there could be only one way to travel that is Tourist visa.
http://www.migri.fi/services/faq/residence_permits

11. May I wait for the decision on my resident permit application in Finland?
1. When you submit your application to a Finnish embassy, you may visit Finland during the time your application is pending, but you must return to your home country when your visa or visa-free period expires
2. If you submit your application to the police, you may reside in Finland while your application is pending, even if your visa or visa-free period expires during this time. If you are not granted a residence permit, you may be refused entry to Finland.

So as per above can she apply both visa's together?

Second thing same from my first query. 2. Apply for tourist visa in India and then apply for dependent visa after arrival in Finland. Please let me know how much is this valid and working possible.
Thanks in advance.

Regards.

Every RP application for your wife will have the end of this year as end date. (your end date)
As the processing time is probably longer than that, she will be denied.
If she is already in Finland, she has to leave.
Starting a RP application for your wife when your extension is still pending will confuse the process.

Wait till your extension is approved and then apply for her.
In the mean time she can come on a 3 months tourist visa (but she has to leave as your application is not ready yet).
Applying for her in India (when you have the extension) is the easiest way.

It is not usually the recommended route, though perhaps you qualify based on the second item on the list?:
aliens who have entered the country without
residence permits
(1) An alien who has entered the country
without a residence permit is issued with a
temporary or continuous residence permit in
Finland if the requirements for issuing such a
residence permit at a Finnish diplomatic or
consular mission abroad are met, and if:
1) the alien or at least one of his or her
parents or grandparents is or has been a
Finnish citizen by birth;
2) the alien has already, before entering
Finland, lived together with his or her
married spouse who lives in Finland, or has
continuously lived together for at least two
years in the same household in a marriagelike
relationship with a person who lives in
Finland;
3) refusing a residence permit for an
employed or self-employed person applied
for in Finland would be unfounded from the
alien’s or employer’s point of view;
4) the alien has before entering Finland
resided in another Member State for the
purposes of carrying out scientific research
referred to in the Directive on researchers,
and applies for a residence permit in Finland
for the same purpose or is a family member
of such a person; or
5) refusing a residence permit would be
manifestly unreasonable.
