YT Negotiations

Post by Aegil » Thu Mar 21, 2013 5:17 pm

Hey,
So I currently work for a company in Helsinki which is currently in the process of YT negotiations that started 2 weeks ago with the aim to lay of 45 staff out of about 80. They have one employee representative who is working for the company but isn't Finnish or 100% familiar with the Finnish law.

Day 1 of negotiations
On the first meeting the company made an offer of 6 weeks pay plus holidays on the basis that staff would end their contract that week. Offer was valid 1 week.

Week 2
This week was the second meeting after 2 weeks and now the employee representitive has asked for a vote if people want to end the negotiations next week so people will know who is being laid off. As part of that employees would only get notice period + holidays and would lose about a months pay from the remaining YT negotiation time.

So now people will vote yes or no. Personally I think this is a bad idea and voted no. But in the event that most people vote Yes where do I stand. Is it the case that 100% of people have to vote yes or are there some more rules regarding this.

Furthermore as an employee rather than the employee rep is there anything else I can do to help myself in this case.

I have been reading what I can find online but what advice could you give and what should I know about YT negotiatons.

Any links or sites would be helpful also. I've read what I can find on google myself.

Thanks

So you were given the option of the silk rope, you didn't take it. Now you wait for the rusty axe.

Are you member of union? They will tell you what to do. Mostly I would not approve anything before spoken to your union (that is what they advise). If you know your union you should look online and contact them.

Hey,

thanks.

I think I'm fully aware of the redundancy law now as it pertains to my circumstances. I just have a couple of questions regarding Temporary Layoffs

Temporary Layoffs are another option on the table for next week. From what I can see there is a notice period of 14 days. Does this come from the beginning of the YT negotiations or from the end. The YT negotiations haven't said there temporary layoffs are the goal, just a reduction in cost.

Furthermore, during the temporary layoffs do they have to specify a length.

Also, if they lay me off for any significant amount of time what happens with regards to my holiday pay and notice period. If I find a job and give notice do they have to pay the 30days notice per my contract or because I am on layoff I just get holiday pay or nothing. With notice period and full holidays I work out 2 month salary due to myself in the case of being layed off, but I am unsure in terms of Temporary layoffs and my entitlements there.

Im wondering if the Collective agreements you work under have to be established before some of your questions can be answered.?

You don't have notice period during temporary layoffs, you can just hop to new job. After 200 days your resignation equals firing and they have to pay the notice period. Holiday pay is usually paid only after you return to your job after holidays, the wages of holidays you didn't take will be paid to you after you quit.
