Hi,

I have been studying in Finland from 2009 to 2013, I recently graduated form a polytechnic (Bachelor Degree in Information Technology). But due my problems with student resident permit in the year 2010 (I asked money from a friend and the whole thing got messed up) the case went on in the courts for nearly 2 years with several other things and a negative decisions. Although I managed to finish my studies in June 2013 and it was the same time I got deported with a 2 years ban to enter in Schengen territory. So now I am back to my country.

During 2010 to 2013 I was working in a small co-op inside the university from which I got few projects and I manage to survive on that economically. I finished almost 90% of my studies in early 2012. I started working on lots of different startup projects. I also manage to open and work with few other people in a company in 2012, from June 2012 to December I was granted "startti-raha" to work in my own company but the project we were doing didn't turn out well and we dropped the idea. I applied for work permit at the time. Then due to deportation decision from the case of 2010 and the situation of the company we dissolved it. We lacked work force and new idea to work on. I got a contracted job in same old co-op and I worked there from January to May 2013. This time my previous partner didn't responded to the email sent by authority about the work permit that I applied in 2012 and I was unaware of it. Later when I called to the authority, I got a reply that my permit was denied due to lack of response.

But the person I worked with in my thesis project, this person is a Finnish guy, same person who actually gave me money to apply for student permit in 2010, he and me we have been working in different ideas and trying to make something new since the beginning. He had a project and we were already working with when I was in Finland. Now his company has been doing good and he wants me to come to Finland to work with him on the project we started. It is a project that requires lot programming and working/handling servers which is a combination I have acquired with my previous work(programming) and studies(networking).

So he is willing to make any kind of contracts and papers required for my new employment resident permit. The thing I want to know from the forum members is that the impression that will make having "Finland" under section C.7 of permit form OLE_TY1 "Have you been subject to a refusal of entry into the Schengen territory?" and with a time that started in April 2013 and will be until April 2015. Also what kind of extra document and papers will make my application a strong one.

My Finnish bank account still open, my tax papers are still valid, even the % is also fine and my phone's contract is still going on and it still works :D .

A calendar of May 2015.

The ban was for things you have done in the past. It won't go away with new ideas or opportunities in the present.
Trying to circumvent the ban by supplying false information will only lead to a longer ban.

If the work is mainly coding you can do that at home (distance work). Then move here after the ban is over.

I am aware of that and I won't be supplying any false statements. I know I have rights to apply again and also the ban can be lifted if Finnish authority wants it to be. That is what my lawyer said. The only thing I am concerned is that with my situation is there some papers or letters from other authority in Finland would help or not. If someone here already know such case. I was doing remote work until now and when I was in Finland. Now my work requires physical access to the premises and setting up the things to run. It is impossible for me with the infrastructure I have in my current country to work for such things.

If you have a lawyer already, why don't ask him?

If you have a lawyer already, why don't ask him?
My lawyer is on vacation until 19th of this month and I finally got an appointment on 22nd of this month in Embassy here. As it takes at least a week for my employer to send the necessary documents. Help from the lawyer is not possible at the moment. I was hoping that I would find some one having similar issue before or a person with some legal ideas.

That would change your chances for removal of said ban.
The reason for my negative decision was "I don't have enough money to stay in Finland" and "I was trying to fake my bank statement". At that time it was easier for me to get money (i had 1500 and I got 4500) from my friend than from my parents. It was same for me, I have to pay back my parents also. So when police asked me my bank statement after 3 months of the application, I gave some of the money (around 2 months after) I don't need (4500) back to my friend.

Also if adding other documents is not necessary, I don't want to clutter my application, I will have only the papers required for the application.

Some other info:
During the appeals in the court, I got money from my parents and I had it with me for all the time. I gave my earnings report from the company I worked (it was not a permanent job, it was project wise). The negative decision from the court came with a reply that "Taking into consideration all the documents I used during my permit application, the decision will be still negative". None of my documents during my appeal were actually used. With the reason said, I actually continued living in Finland for next 3 years and support myself.

Later I knew few other people who also didn't have the money and they were actually sharing money among friends. So when they were also asked for second statement from the bank they didn't have it. But they got their permit. I have been skeptic about this for long time and felt little bit discrimination from the authorities also. I felt that the situation was created for some statistical report of how good they have been working. State(tax payers money) was paying for my lawyers fee, state was paying for all those people working with my case and state was paying me to start a business. The whole thing is quite funny and I have no idea who is benefiting from all these. I like Finland and friends I have there, I have been more emotionally attached to Finland than my own country. That's why I want to come there again and live with my girlfriend, work and pay taxes.

Why dont you scan your documents so we can look? Mainly decisions from maahanmuuttovirasto and why dont you tell them about "other people". Do you have anything in paper or anything about those?

Good business, you have to be broke to get state... so there goes your "business"

Why dont you scan your documents so we can look? Mainly decisions from maahanmuuttovirasto and why don't you tell them about "other people". Do you have anything in paper or anything about those?
I will put it after few hours, I am away from home at the moment

I went to the Turku Administrative Court for my appeal against the fine (not the main case, i appealed against fine of some amount of money), I raised the question about "other people", the answer from the police was "There are many cases with the police, some gets resolved some don't" . I didn't know what to reply to that.
