Post by sanilittle » Fri Aug 16, 2013 5:26 pm

hi.
I need some help. Please guide me if someone had similar experience. I have been in Finland for one year as student. I completed 65 ECTS of my master degree but now i have already married with Finnish women she is 40 years old and I am 27 years. now should I apply for study residence permit or on the basis of finnish citizen's spouse. Is age difference can be a big problem to get RP. we have married in August but we have been living together since Febraury. any suggestion will be highly appreciated.

family ties as the poster above me responded.
The age of your spouse doesn't matter. They don't care if you marry a granny or a corpse freshly dug out of the graveyard as long as your paper work has no hanky panky.

The age difference might raise some eyebrows. They might even interview you both before they make the decision.
But since you're already here and (probably) qualify for a students rp I don't think it is a big deal.
So go for the family RP.

Thanks a lot to everyone for sincere suggestions. Yes i qualify for student Residence permit and I am also working on Posti as a newspaper deliverer.because I am from third world country and age difference can create little doubt. but my case is strong as i officially shifted with my 7 months before our marriage. I have all documents to support that as well.
Furthermore, do I need to fill MP1 form that is for refusal to entry in case of negative decision. On application form it is written like that
"If you are already in Finland and are applying for your first residence permit, you must fill in a response to refusal of entry (form MP_1) and append it to your application."
but my student residence permit will expire in 25th august 2013. In case my RP on family ties is refused do I still have chance to apply on the basis of my studies or not?
you guys have already help me a lot. Please find sometime to reply this post as well I will be grateful to you guys.....

So is it your first? Assuming you already have a permit then you don't need to fill that application.

If the appeal is also rejected and you're still studying then it's only natural to apply on the basis of studies.[/quote]
Thanks for your comments. yes i have first residence permit B on my study basis but it will expire when i apply on family ties. thanks for info.

It would be his first RP based on family ties, so he would have to fill that one out.

If you apply based on family ties, you will not be allowed to work between the expiration of your student RP and the granting of your RP based on family ties.

Thank you so much Adrian. You have raised a very valid point.... mean if i cant study and work during the process of my RP on family ties than it is not wise to apply on family ties. I should apply on my studies that is fullfil all the requirement of student Residence permit.
again i am thankful to you adrian.

Afaik you can study while you reside legally here and waiting for RP is legal. Working without RP is nono.

Thank you everybody for help. there is no need to fill form MP1 and if residence permit is applied for extension work is allowed until any decision is not made. I got all info from police station today.....
