Divorce papers x abroad
Hi,
I come from South America, and I´ve been living here for many years now. Been married with a finn and we got married in Finland. Things haven´t been working for a while, so I want to divorce him. Problem is that I dont´t think is safe for me, or can afford to stay here for 6 months during the "consideration period" after we´ve signed the papers. I really wanna go back to my home country. Is it possible to do this?
I mean, sign the first paper and leave Finland and still get the other papers to sign in my home country? Or do I have to come back here 6 months later to sign the paper? Is it possible to do the divorce all at once, without this consideration period? I am sorry if this questions sounds silly, I must confess I am quite ignorant when comes to divorce, laws and things like that. I´ve been trying to book a time with this kunnallinen oikeusaputoimisto to get some answers, but I am already so anxious, so if someone could help me would be nice.
We do not have any properties or kids. We only have a cat (that he was not interested in having or buying it, so I wen alone thru all the procedure of looking and finding the cat and bought with my own savings) and believe me or not, he has been threatening me, saying that I can leave the country whenever I want, but my cat stays with him. Again, sounds silly, but this cat is what has been keeping me sane, I love him to death, if you have a pet, you will understand. The cat´s pedigree and passport is registered under my name and I have a note, provided from the breeder who sold, with my signature and the amount paid for it, can that help me keep the cat somehow?

It is a relief to know they can mail me the papers!
He would never hurt the poor animal, but he will keep it no matter what to hurt me, that´s typical him, this vendetta kind of behavior.
That´s why I fear for me when I leave, he won´t let go of the kitty and I won´t leave it here. This cat is the only thing I have, my mental health, my joy and my dreams were all taken by this man. In case things get ugly and he gets aggressive, call the police and show the papers to safely leave the house with the cat would be overreacting? I mean, I can prove I bought it.

The courts even accept papers through email:

Since you have been living here a while you probably have Finnish online banking credentials in case they want an electronic signature (to create one a service like onnistuu.fi can be used).

As others pointed out, you can use mail to keep the divorce procedure up and running.
Your cat story reminded me of my ex who wanted to take my computer and my HOTAS setup away from me, although I paid for each and every component (got receipts for everything paid by card from account solely under my name). That was pretty hilarious as she couldn't tell the difference between USB and Ethernet port, and yet she wanted to take my machine away just to annoy me. When I pointed out that in this case, I will take her shoes and handbags and jewelery (part of them were gifted by me) then it calmed her down to some extend.

Also, when the paper comes it is one A4 that has the case number and one sentence. Doesn't look impressive. However, they can write you an impressive-looking "EU certificate" which has the translations... I think also in Spanish and Portugese, that you are divorced, with stamps and so forth, and if you can get that apostilled, it looks so impressive your local office clerk - if they know you were married and you need to inform them - will be amazed and ask you on a date

There is no country called "south america". There are plenty of countries what are in south of united states of america but they dont have common law so.... Its like i would say im from europe, that doesnt tell anything and in legal point... Well maybe bit more than "south america" but still nothing. If you really want a help you tell me where papers will be used and "south america" isnt one where you can use anything because it doesnt exist. You forgot that people in here do know if there is problems with finnish papers but to tell that they have to know where you intend to use those.Rakel wrote:Hi,

Short googling gave 14 different countries in south america, and i assume every one of those have different laws.
You assume everything in south america is same and assume that its enough to know that you are from south america... thats rude and ignorant.

The only thing I asked was wether is possible to deal with finnish divorce while living abroad, if the maistraatti would send the papers abroad.
As others answered prior your insulting message, yes, it is possible to send the papers to Finland while abroad. Thats is why I did not understand your insultation if my question was already answered by at leasr 3 person.
Havent asked a single advice about dealing with the divorce in my home country, thats why did not state where I am from.
Now if you please, I came here looking for help, not to be insulted or deal with ur BS.

What i know its irrelevant if finns accept your divorce, you want to get divorce in your country.
You dont live in finland and seems that you dont plan to live in here so being married in finland wont matter. Being married matters to you so there has to be something in your country.

Nope, I asked exactly what I meant to, did not forget to add anything. You assume a lot, and assume wrong. We got married in Finland, my marriage is not even registered in my home country. I just wanted to know if was possible to sign the first paper, leave the country and do the rest by mail. Very disrespectful of you saying that does not matter if I am married in Finland even though i m not planning to live here. What matters or not in MY DIVORCE is up tp me. Regarless of leaving here, of course I want the whole thing finalized.

You wanted help on legal matter, you didnt provide info. You claimed that your home counry was unneseccary.
Of course its unnecessary if you do want to undo marriage in finland but why you would want it if thats not needed in your country...
