There is no strict rule for it, but the avioehto can be partly or completely ignored if it considered to lead to "unjust" result. Most likely to apply with case of stay-at-home mother with kids who no here own right would be close to broke. If there is no will, (s)he will inherit all. After both a dead, any heirs (parents, siblings and their children) will inherit them both (one part to the other family, one to the other, except if there are no valid heirs on the other branch).
