Marriage whilst waiting for Visa decision?

Hi!

I am a UK citizen working and residing permanently in Finland. My Fiancee is Russian and has been living and working in Finland for the last year, she is currently waiting for a decision for her a Visa Renewal, so currently not "legal".

We are expecting a baby and would like to create a good life for ourselves here and as such want to be married. After consulting a lawyer, we were told that as she has a visa application pending, she would not need to provide a visa to the Maistraatti when applying the marriage certficate.

I have been trying to find this "law" in writing somewhere but am not having much luck so far! Has anyone been in this or a similar situation before? or can shed any light on the situation for me?

Any help would be greatly appriciated!

Its not a visa, its a residence permit, and she is "legal". Under the section of renewal. She needs to show the receipt she got of the submitted application.

You could get legally married here even if she were a tourist (and to best of my knowledge even truly illegal alien). Her status really effects only documentation related to having no impediments to marriage (mostly not being married currently). Contact the magistrate (or church) were you intend to get married directly to get started with correct documentation (Certificate of Non-Impediment).

(and while I think it is not even relevant here, yes, she is considered "legal" while the permit application is being processed even if the old had now expired)
