Power of attorney

Post by navi_sid » Wed May 07, 2014 5:59 pm

Hi,

I have a land in India which I want to sell. I have buyer for it but I am not able to go to my place because of some unwanted reasons. :( I thought of giving my father a 'Power of Attorney', so he can sell the land on my behalf. But I am not sure about the process of getting one from Finland.

Can anyone help me to understand is it possible to have a attorney created for my father and if yes, than where should I go for it. will it be the Polisi or somewhere else?

Thanks in advance!

The sale will happen in India so the power of attorney has to be valid in India. This means understanding the Indian rules about it and you are in better position to Google it than Finns are. If you decide that you need something apostilled then that happens in the Local Registration Office (Maistraatti).

Such documents are usually have to be apostilled . See further for the signatories of the apostille convention (India is one of them) . But beware of the fact that unlike simple Finnish POA thus one should be confirmed by the public notary. Actually apostille can be affixed only to an "official " signature (that is of a judge, notary etc.). So I think that the best way is to get to a public notary (in most countries they can arrange for apostille themselves) .
In Finland public notary functions are executed by the local registry office (maistratti). So just go there , take the document that you want to notaries and apostille and your ID , that should suffice. I advise you to agree upon the text of POA in advance with the end user in India, to make sure that the wording is correct and suitable for your case.
