RP in Process. Problem
Greetings,
I'm currently in a weird situation. I'm in Helsinki as a student,I placed my application here in Finland once I got approved and I am currently studying. Currently my r.p. is still being decided on, I got in a physical altercation with someone in a bus (No it wasn't a finn) I got contacted for questioning from the police, they said the other party is filing assault & threat against me.The residence permit application is "stuck" since August, I asked the police officer who took the questioning if this assault charge is the reason my r.p. is still undecided and she said yes :\
So my question is basically,Since I got into a fight while my resident permit is being processed, am I in any danger of getting a denial? I was reading the Finnish penalty code and it specifies that for a petty assault charge its a fine.
Any feedback will me much appreciated,
thank you.

I know I know, I'm being a prick, but I wish you get your application denied. Sadly, of course, you'll get the thing settled in your next mediation hearing and you'll get your RP approved.
Every case is unique. You can't measure the result of your application based on arbitrary anecdotes online.

This already a reason on its own to deny your permit. The law only allows student permits to be applied abroad in the embassy.peckpeck20 wrote:I'm in Helsinki as a student,I placed my application here in Finland once I got approved and I am currently studying.

Re: RP in Process. Problem
I arrived to Finland back in April for the admission exam and had my return ticket in July.In June I got the approval letter from the University,I went to the police station in Pasila and asked if I can apply while I'm already here in Finland and they said I could So I did. Currently my tourist visa expired and I have a paper from Migri that says my permit is in process & staying here legally.

You can always apply regardless of the merits of your application.peckpeck20 wrote:I arrived to Finland back in April for the admission exam and had my return ticket in July.In June I got the approval letter from the University,I went to the police station in Pasila and asked if I can apply while I'm already here in Finland and they said I could So I did.
Not sure about the latter part without seeing the paper. However, they do seem to be making exceptions that they are not legally allowed to make.peckpeck20 wrote: Currently my tourist visa expired and I have a paper from Migri that says my permit is in process & staying here legally.

Why would Finland want a violent person in the country?
I hope they deny you. But probably you'll get to stay.

Re: RP in Process. Problem
The fact that they wait is to me a clear sign that they consider the rule possibly applicable in this case. I do not care to guess how it will end up in practice.Section 36
General requirements for issuing residence
permits
(1) A residence permit may be refused if
the alien is considered a danger to public
order(...)

Short answer: yes.Since I got into a fight while my resident permit is being processed, am I in any danger of getting a denial?
Although a short quarrel and one or two punches thrown probably is not enough for a denial (those things happen regularly on Friday and Saturday nights), it might be the tipping point when other factors are not 100% convincing.

You got physical with someone and IF he touched you/returned even a slap in any way you should also sue him as well. get one of the student lawywers who are very cheap and blame everything on him. Also remenber you do not know what the Finnish laws are and play dumb. Say the guy was too close and you feared for your life and no space in the bus to escape e.t.c.
the ministry of education has already paid for your tution for the whole semester, get the credits and even ask one of the management to listen to your case. whatever the decision the courts or migri will make if not in your favour Appeal immediately. assault is no big deal, the case will take over a year to be heard so remember to be apologetic about the scenario that happened, explain reasonably why you did it (make it his fault or alchohol from a friend birthday like koskenkorva which you had never tasted and had bad hangover for a week after tripping) and tell them your studies cannot be messed by one incident looong time ago.
you will walk. been there done that.

Re: RP in Process. Problem
Well if say someone was trying to nick my wallet and I kicked his ass would that make me a danger to society? Except to the criminal society, but I want to be judged by my peers and not human garbage. By the sounds of it the other party is one of these "honor citizens" who have a hotline to a lawyer - its never their fault anything.
So yes - OP, get a lawyer on your case.
BTW - care to entertain us with what *exactly* happened. I can probably say where and what the chapter and verse is.

A) OP did not mention that nothing like that happenedPursuivant wrote:Well if say someone was trying to nick my wallet and I kicked his ass would that make me a danger to society?
B) The law and courts in this in this country kind of like say "Yes" (whether you or me like it or not)
Based on OP''s short posting history, I'd be more likely to bet my two cents for the opposite case.By the sounds of it the other party is one of these "honor citizens" who have a hotline to a lawyer - its never their fault anything.![]()
