unemployment and effect on residence permit

Post by trilogy1920 » Fri Nov 07, 2014 12:23 pm

Hello
Aliens act section 58 para 4 says that a residence permit can be revoked if the grounds regarding granting residence permits no longer exist.

I have still 2 years left on my A type residence permit and have recently lost my work contract, if I go to te toimisto and register as job seeker and get unemployment allowance from Kela, unless I get another work contract, wont police know about it and cancel my residence permit.

If After 2 years I have a job I apply for permanent residence permit( for which i qualify), wont they object why was I getting unemployment allowance from Kela as it will be on my tax returns for last year.

Any experiences please share or anything I have missed stated in law.

Do you have restrictions on field of work? If so you can't register according to TE-office:

I don't know if this also disqualifies you from Kela benefits. Have you registered with an unemployment fund (everyone really should do it)? Then you can ask them for help.

The permanent permit does not have a requirement to have been employed all the time. If you are working at the time, then you obviously haven't been deported so it's fine. While the possibility for deportation exists, I would think it's super counter productive for the police to decide to do so for short term unemployment.

It says it can be, not that it will be. Next time you are renewing it its more crucial. The data privacy laws prohibit Kela informing the police, so its not like they'd come after you.

Unless your employer informs the police or Migri, then you're good.

Do you have restrictions on field of work? If so you can't register according to TE-office:
Correct me if I'm wrong, but doesn't the TE-office restriction apply only if your RP is linked to a specific company?
Every case is unique. You can't measure the result of your application based on arbitrary anecdotes online.

They're highly encouraged to inform Migri about the termination of employment. I haven't encountered any workplace that did that. I don't know about my current employer.. yet

Please shed some more light or share a link, so someone with cleaner or selfemployed or IT servces written on his residence permit can still be considered as unrestricted residence permit for tetoimisto.
So its only if the name of employer us written on residence permit, makes it restricted.

Thanks. TE Office have confirmed that a residence permit is only considered restricted if the name of employer is written on it.
Otherwise all other continuous A type RP are ok.

Lovely. That's what I thought. Good to hear that you got a confirmation, and good luck to you.
