Appying for RP when husband is unemployed - is it possible?

To make it clear, here is our situation:

Me - Vietnamse, my husband - Finn. We got married 2 years ago. He has been working projects around Asia, I have been running my business in Vietnam. Sometimes he takes holiday to stay with me Vietnam, sometimes I come to stay with him for a few months. We do not want to continue like this anymore. His contract will end in almost 2 months. We decide that he will not extend the contract and will apply for another job in Finland, and I will apply for RP.

The thing is maybe in the next few months he can not find any job, but we still want that I move to Finland as soon as possible. Is it possible to get my RP application approved if he is unemployed? Or is it a high risk to apply?

His employment status has nothing to do with RP application but your cohabitation !

As by your note you both are living abroad however not cohabiting at same address - that can be tricky - because by law (a common law partner or married - both are categories of a spouse) but they need to be registered at finnish population data - your partner needs to register you both in Finland first that is by any legal mean of cohabitation as by rule you required to live together for two or more years before been granted RP or simply a marriage cert.

If can be a can of worms.
As a spouse of a Finnish citizen you're entitled to a RP. Not depending on income or so.
But your situation; married but not really living together, he unemployed when he comes back, you unemployed(?) might raise some eyebrows.
And then it is easy to find reasons to deny the RP (fake marriage suspicion).
It should be no problem but be prepared for some difficult questions and make sure you have documentation about your times together.

Hi guys,

We were together for about 1 year (we worked in the same project in VN), then we engaged, then married after three years, then he wanted to continued his project work, I did not want to quit my job in VNam to follow him here and there all the time. I know it sounds crazy! We want to stop it now and stay together.

So do you guys mean not cohabitating is the biggest problem now even I am a registered spouse?

As for documentation, we have all stamps on our passports to show our time together (once or twice a year, of course only tourist visas), sms or call everyday, bank transfers, ... Will these be a plus?

If still yes for moving, I must quit my job in VNam.

If already married or in a registered partnership and that is registered in Finnish system - than you are good to go!
you do not need to be worried of anything :thumbsup:

If the marriage can be considered fake, that IS a problem.

Thank you all very much for showing out all possibilities.

Our case is not popular I know, as my husband's job requires travelling all the time, and moreover he stays in each place in a short time, so my application for a residence permit following his working visa never makes sense. We can say we have a lot of evidence for our real marriage, and most important, it's real. I hope things goes well.

I'm also Vietnamese and my situation near the same you. We just finished registed marriage at VN March and my husband also finished registerd our marriage at Finland 2 days ago. Beside, I applied RP card 16 March and still waitting result. Before I been applied travel visa 2 time but refused all :( My husband currently unemployed but he living at Finland. Not work outside as your. I'm worry for my RP card too. :(
