My nigerian husband´s visa was denied. How to appeal?

Post by AmyAmy » Fri Aug 22, 2014 5:19 pm

I got married to my husband in Nigeria in January 2014. We have know each other since spring 2013 and we have lived together for some months in another African country. Since the marriage we started organizing all the papers for his visit. I took almost 6 months to get all the right papers and legalize our marriage certificate which was done through Finnish embassy in Abuja.

Finally he had appointment for visa interview 5th of august but the visa was refused. All the papers were fine but "your intention to leave the territory of the Member States before the expiry of the visa could not be ascertained". He has his business in Nigeria so he was meant to stay here only for a month. During his stay we were meant to plan the future and I really need him here since we haven´t seen each other for 8 months now. He can of course apply for residence permit but in that case it will take 6-8 months more.

So, please give us any advice on how to appeal on refused visa. How can we convince them that my husband has only good (legal) intentions. I contacted lawyer in Finland but it cost at least 1000 € to get advice from them and the result is not guaranteed. Should we use lawyer, is it worth of it? I´m planning to write a letter and also make my parents to write. What else can we do? Thanks for help!

You should have received written instructions on how to appeal with the refusal.

You will need a paper trail (job contracts, return tickets etc.). Given the statistical likelihood of abuse from Africa, they will not take your word for it at this point.

The easiest course of action would be for you to go to Nigeria and start a new life with your husband there.
