A bit of a legal question about living in finland?

Post by stargirlz » Tue Jun 16, 2015 12:49 pm

Okay so my situation is tricky at best.. I am married to a Finnish citizen. I have been in finland for the last 3 years so whats my question? Do i have to apply for citizenship to keep living here in a year or can i keep renewing my permit as long as i am in the country?

The reason I ask this is because I have mental disabilities that are not really allowing me to be the normal type of person and learn in a normal situation. I am easier taught one on one. Which is fine since I have been learning the language with my husband and not at a classroom. It's more like having a private tutor? Being taught one on one with him. I am concerned since i am being taught the language at home, i am worried i wont be able to learn the language fully in time, as far as i am aware you must know the language to apply for citizenship. I am in a bit of crutch on what to do.

So I guess my question is can i just keep renewing my permit in the mean time?

So, there are four angles for this:

1. There's no law that forces you to apply for a Finnish citizenship. You can basically keep renewing your residence permit as long as you like (given that that you still fit the requirements).
2. After living in Finland for 4 years under your residence permit, you can apply for a permanent residence permit (one that you generally don't need to renew anymore).
3. You don't need to "know the language" to pass the test. You can pass the test with quite minimal knowledge in Finnish.
4. If your learning disability is legitimate, you can either apply for a special test process with the YKI test people, or you can apply for an exception for waiving the Finnish language requirement for citizenship (rarely granted).
Every case is unique. You can't measure the result of your application based on arbitrary anecdotes online.

The permanent permit does not need renewal, but the physical card has an expiry date (5 years). As long as one does not move out of the country or commit serious crime (like murder) permit really is permanent and renewing the card is similar to renewing the passport for citizens (= you do not need to fulfill any particular conditions to do that).

"An alien may be granted Finnish citizenship notwithstanding section 13(1)(6), if he or she
cannot meet the language skills requirement because of his or her state of health, sensory
handicap or a speech defect."

This doesn't apply to me though because I am not phrically handicapped or have a speech defect. I just have mental disorders. Social anxiety/bipolar disorder/Borderline personality disorder. All officially diagnosed since a very young age. I honestly don't have my records though have recently asked my parents to help me out, so i can get them sent to me. I been seriously needing to see therapist over here. Due to lack of medication and wanting all my records before going.

See I have looked into this a tiny bit, and the requirement pretty much states if your mentally handicapped they won't grant the citizenship. -shrugs- This is why i am unsure what to do.
I figured I could keep renewing my permit but i wasn't sure if there was a special requirement for this?

That's not a mental disability; it's a mental illness.

Yeah, now you're just making sh*t up. That's just not true.

It seems like you really don't know what you're talking about, so let me break it down for you:

- You're not forced to apply for citizenship, you can get a permanent residence permit and just keep "renewing" the card.
- Your situation doesn't prevent you from learning the language to B1 level, so it's highly unlikely that you'll be granted an exception.

That's it. As simple as that.
Every case is unique. You can't measure the result of your application based on arbitrary anecdotes online.
