Consumer rights while buying second hand goods

Consumer rights while buying second hand goods

Hello all,

I recently tried to buy a bed frame (wooden) along with other stuff (dining table, work desk etc) from Kontti (http://kontti.punainenristi.fi/), a second hand store. They promised to deliver the bed and the other things that I bought to my home after a 2 days. The very next day I went there and tried to cancel the bed as I am unable to find a mattress for the bed I ordered from other second hand stores, which was still technically with them because they did not deliver it to me yet.

Initially they said that they cannot cancel or exchange the orders. Then later they said that I can choose other beds which are available from there, I did not like the offer as I did not find any other beds good enough. Later they said that they will talk to their boss and call me. Some one who was delegated to me called me the next day and said that they cannot return the money I paid but I can choose other things to buy from Kontti. I said OK reluctantly. I am not sure how the consumer rights apply in this case. As Kontti guys are flatly refusing to pay me my money for the stuff which is technically still with them.

I understand that they are second hand goods but still this is sort of stretching a bit too far. I am not sure. Can anybody whose knows these things comment on this issue please?

I went through the pdf, but there is no reference or chapter on used or second-hand goods. Does the second hand goods fall under a special category? I also tried to search the document for "second" and did not find anything. Could you please point me to the exact chapter?

That is because there is no special provision for second-hand goods. What you are trying to do is cancel the sale. Seller has no obligation to do that.

You bought it in a brick and mortar shop. Unlike in an online shop there is no 14 days reflection period. You bought it, it's yours now. If you don't want it, you can try to change it or return it under the conditions of the shop. And they did offer you a credit for your next purchase, so that is not an unreasonable practice.
I'm afraid you're stuck in this situation.

Well, you are not quite correct here. I am involved in Kierrätyskeskus Recycling Center and we come to pick up and resell those second-hand mattresses and beds and such, providing that
they are in good condition.
