Dear All,

Need advise on a situation in my rental flat that I have not faced before. I moved to a rental in September this year. Landlord did not inform us anything the ongoing and upcoming maintenance work. During first two months, roof replacement was going on during day time, every though we were in ground floor it was quite a disturbance for my pregnant wife who was in home all the time. We thought it is a one off case and moved on. Now, all windows and terrace door are to be replaced from march 1st week. Landlord told me there will be big crane right infront of my flat to lift things and it will take 3 days to complete the work in my flat and there will be quite lot of dust and nosie during the work. I have a new born in home, so wondering is it wish to keep him in home during the time when replacement going in my flat. Also I worried about the noise from the replacement work which would continue for months.

People who have experienced windows and door replacement during peak winter, please share your thoughts. Also wondering how is this situation viewed in law governing rental homes?.

The landlord was required to notify you before the lease began because he knew about it. Regardless, you do not have to stay there and put up with it. Here is the act in English

By law if the place is uninhabitable or dangerous to your health, you may break the lease without the normal period of notice. And the landlord cannot keep any of your deposit. Or charge a fine. Being freezing cold because the windows are removed. That is uninhabitable. The noise and dust with a newborn. That is dangerous to health. If you would like to, you can send a registered letter to the landlord stating the date you will vacate, and leave. Quote the relevant act number in your letter (it's clause 63).

Here is a translation

§63
The tenant shall have the right to rescind the lease agreement immediately if the
health of the tenant, a member of the tenant’s household or a person in the tenant’s
service is manifestly endangered by use of the apartment for the purpose specified
in the agreement.

One other option is to demand a rent discount for the period of the work.

Great recommendation :thumbsup:
Especially if your health isn't negatively affected. You get compensation and you stay in your apartment if you don't hate it so much.
Every case is unique. You can't measure the result of your application based on arbitrary anecdotes online.
