Divorce
I happened to walk into a bar an hour ago and met an old friend who although not a lawyer is in the know from personal experience..
He said...what your husband says is complete and absolute...hevosen paska..i.e rubbish..there have been cases where couples have split up after a fight at the wedding reception and it has still been a 50/50 split!
I think I told you once before tell your husband..haistu viittuuu!

OK, so then they'll send a 2nd notice when the 6 months "thinking period" starts.AleXa wrote:well, i got those divorce notifications just today. it said that i have to return the notification to the kääräoikeus with my signature as soon as possible..thats ok with that....
Dievushka, if he has a gavnoyed speaking this, you have to get another gavnoyed to counterbalance. You can get public assisitance and lawyers are not *that* expensive. You can come to agreement, but unless you go sign a paper or sign over the house title, he cannot sell it without you, as he owns only half.AleXa wrote:well, he had been visiting lawyer and said that there is no 50 / 50 because we havent been married long enough for that splitting..but i m still the half owner of the house..or am i not anymore automatically after divorce?
Get in contact with this baranova woman I put the link to at the womens centre in Turku. They can give information what to do with the stuff.
Get on the telephone, harashoo?
Cheers, Hank W.

some news again..
now he is saying--i will cancell divorce and we will make marriage contract..
he is affraid to loose money!..
at the same time i start to think that if he cancel it, then i could have my pemit to stay in finland..dilemma again..
the cancellation of divorce at this stage ( one month since i got the first papers.)..is it possible actually? or he is trying to cheat again?..

Like any contract it requires at least the two main parties to sign it..tjawatts wrote:Surely marriage contracts have to be drawn up BEFORE marriage not afterwards. If you go into a marriage without a contract then you have the automatic rights.
Just my opinion.

So tell him you will hang it in the toilet as decoration ..but it will not be signed !
well, i did contact the lawyer. she said that actually its not a bad idea to sign it..
statements would be that if he would cancel the divorce ( or will not put the second paper after 6 monnths.) , then i agree to leave him a house. in that case he would stay with a house and i will get my permanent visa..
though its a bit tricky to right it on a paper..maybe some have an idea how to put it right in a paper..for example-- i agree to leave him his property if our marriage would last for one more year or smth like that,,?..
and one more question--when applying in police for the permanent residence permit, does he have to be there with me, or i can do it by myself?

OK, I am not sure I understand the above, but your lawyer suggests that signing an agreement that waives your rights is a good idea?
1) Signing a contract under duress normally voids the contract, this is surely duress.
2) Why would you want to give up your existing rights? Your husband does not have any sway over the issuance of your permanent residence visa.
3) Are you sure that your lawyer does not have a thing against Russians, coz the advice seems, as reported, a touch cack handed.

1. why do u think its a duress?.. if its a mutual contract, he would stay with a house and i would get my permanent residence permit..
2. I had been married for 1,5 year, and the divorce is already in process, so i will not get the permanent residence permit and have to go back to Russia. But by contract, if the divorce would be canceled i would stay in Finland then. which is more important than the money to me
3. cannot say for sure if she has anythíng against russians..she even speaks russian language, and my friends had been counselling with her too..she has good references..
but yes, i d like to talk to some other lawyer as well, to listen some other opinion.
Does anyone know a lawyer by phone? some counselling by phone, no need to visit.

but...here is more news..and i am really totally confused again..
he is telling that he may cancell the divorce now, without wanting me sing any contract..he is saying that he wants to do it cause he wants me to stay in finland..but i am very suspicious and see some hidding reason for that ( like he is affraid to loose the money..).. though he is keep saying that there is no hidden reason but just he wants that i stay in Finland..
How does the process of cancelation of divorce go?..I heard that we have to go together with him to the court and put papers together that we are both agree to cancel the divorce..is it like that?..
after that is it still in his power to call to UVI for example and try to get me out of Finland?..then if i am not in Finland anymore the property will stay at his name?..and even if that may happen that i will applay for divorce from Russia myself, then would i still have a right to have 50/50 of property?..or i am just imagining?..
huh..sorry for many questions again..before asking lawyer would like to hear some other opinions too..

Calm down and less panic...I wondered where do you get these crazy thoughts from...then I realise your background early life in Russia this sort of thing/thought might be real..But this is Finland not Russia..AleXa wrote: after that is it still in his power to call to UVI for example and try to get me out of Finland?..then if i am not in Finland anymore the property will stay at his name?....
Do you realy think that the UVI will listen to a man who contacts them and says"Please kick my wife out of Finland!" ?
Your husband of course wants the house..but make him sweat a bit, do nothing, take your time, and get pro advice from "EXPERTS"
Have you been in contact with the people that Hank told you to speak to way back when this saga/story started.?
I dont know..are they really so crazy, my thoughts?..he did started divorce , and i think when UVI will be looking at my case thinking to give me permanent residence permit or no..the divorce, even canceled one, might play crucial role. so at the end i will not get a permanent residence permit anyway..
yes , i tried to contact those in KOtiPuu but..i actually didnt not get any replay..
but i ll contact some counseling soon again:)
