Retaining Resident Permit(RP) after divorce

Hi All,

I am a Finn, my husband is an immigrant with a 4 year Resident Permit. He has been in the Finland legally for the last 4 years on marriage type visa and now his 4 years RP will be end 30 Oct 2016. We have been married for more than 4 years. We are not getting along at all anymore, but there are no serious problems. We want to get divorced but neither one of us wants him to lose the RP, despite everything I do still care about him. We didn't get married for the RP, but its still nice for him to have it obviously. what do we have to do in order for him to retain his RP? Additionally, when we get divorced, will he still be able to apply for Permanent RP and citizenship at some point?

Considering the time he has been living here, I guess he could get a new permit even lacking job, but if he has been here already 4 years then why hasn't he applied for permanent permit?

Visa is for visiting, up to three months. Residence permit is for residing. Grounds for RP are for example: work, study, family ties. He should be able to show some grounds for RP when he applies. Family ties end in divorce, unless you have common kids. So he should apply either for work or study RP. Btw, you can't get divorce before the end of his RP, unless you have filed for the divorce already.

Thanks Rip . as the rule, Permanent permit is based on family ties but citizenship is based on 4 years has been living in Finland. Am I correct?

The 4 years rule only applies if the applicant is married to a Finnish citizen.
"If your spouse is a Finnish citizen, it is enough that the applicant lived in Finland
for the last four years without interruption (continuous period of residence)"

You can get a permanent permit after four years on any A class permit , not necessarily family ties.
Citizenship after four years requires either spouse or otherwise close ties. Apparently a steady job is acceptable enough as "close ties" as well.

You don't need family ties for the permanent RP, you need to fulfill the criteria for continuous RP. So work or studies will be accepted too. Or at least should be accepted in my opinion.

Study permits are temporary so studies can't be used as a basis for a permanent permit.

Hi! I think you are quite well informed about this stuff. I am wondering something. Let's say one immigrant is married to a finn. And he has a RP for 1 year now. What if his Finnish wife passes away? Does government send him back to his own country? BTW he is studying but doesn't work and they don't have any children.
