Termination of a permanent work contract by the employer

Post by myray » Fri Sep 09, 2016 10:42 pm

Hi all.
My friend is about to be laid off by his employer and he's on a permanent contract.the employer gave him a written notification and told him when he will stop work in two weeks time. And that the layoff is as a result of economic reasons. Will the employer pay full salary for one or few months since he was on a permanent contract? All ideas are welcomed...thank you .

The notice period depends on how long he had been working. If he had been working for less than a year then 14 days is sufficient.

Collective agreement may be applied even if there is less than 20 people in the company. But even if there is no collective agreement the law applies I.e Employment contract act. If I remember correctly it is 14 days there if one is employed les than a year ... Do check Finlex.fi for that
What do you want from me?????

The law allows anything from zero to six months based on mutual agreement.

True. I doubt there is any TES with shorter periods, so if there isn't specific clause in the personal employment contract, then the notice period is one month (duration of the employment more than one, less than four years). In Finland that means the employer is supposed to pay the salary for that period. If the employer so wishes, the employee has the obligation to continue to work for the whole period.
